This Equivalency Certificate authorizes Air Liquide Canada Inc., to handle, offer for transport or transport, and authorizes any person to handle, offer for transport or transport, on behalf of the certificate holder, by road or railway vehicle, by aircraft, or by ship on a domestic voyage, cylinders in a manner that does not comply with paragraph 5.10(2)(b) of theTransportation of Dangerous Goods Regulations, if:
(a) subject to conditions (b) to (e), each cylinder was authorized for continued use under sections 7.32 and 8.4.2 of the Transportation of Dangerous Goods Regulations in effect on January 1, 2001, and the conditions in those sections are complied with;
(b) each cylinder was manufactured in accordance with the conditions of Special Permit 1897 issued by the Transport Dangerous Goods Directorate of Transport Canada pursuant to the regulations for the transportation of dangerous goods by rail in force before December 5, 1991, and each cylinder is marked "CTC SP1897";
(c) the cylinders were manufactured in accordance with the certificate holder's purchase specification SP-C1, entitled North American Specification for High Pressure Steel Cylinders, filed with the Transport Dangerous Goods Directorate;

(d) each cylinder is owned by the certificate holder and is marked with the letters "ALS";
(e) subject to conditions (f) to (j) of this certificate, the requalification period for each cylinder or a bundle of such cylinders is 10 years provided that the cylinder or each cylinder within the bundle complies with items (a) to (g) of Clause 220.127.116.11 of CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, cited in the rest of this certificate as CSA B339-08;
(f) the water capacity of a each cylinder shall not exceed 57 L;
(g) despite item (a) of Clause 18.104.22.168 of CSA B339-08, if the cylinder is in a bank, group, or rack and is not in a bundle, it is removed from the bank, group, or rack each time it is filled;
(h) for the purpose of this Equivalency Certificate, a bundle is defined as an assembly of cylinders fastened together, interconnected by a manifold, and transported as a unit within a frame;
(i) item (c) of Clause 22.214.171.124 of CSA B339-08 does not apply; and
(j) the requirements of Clauses 126.96.36.199 and 188.8.131.52 of CSA B339-08 apply.
Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

This Equivalency Certificate authorizes the use of seamless steel cylinders manufactured in accordance with Special Permit number 1897 that was issued pursuant to the Canadian Transport Commission (CTC) Regulations for the Transportation of Dangerous Commodities by Rail, with a 10-year requalification period. The 10-year requalification period is applicable to cylinders used exclusively for certain non-corrosive, non-flammable dry gases, and mixtures of these gases in accordance with the provisions set forth in the upcoming edition of CSA Standard B339 as they apply to specification TC-3AAM or CTC-3AA cylinders.
