CONDITIONS

This Equivalency Certificate authorizes Hydro One Networks Inc., to handle, offer for transport or transport dangerous goods that are UN1080, SULPHUR HEXAFLUORIDE, Class 2.2, by road vehicle, in a manner that does not comply with Part 5(c) of the Transportation of Dangerous Goods Act, 1992, subsection 5.1(2) and subparagraph 5.10(1)(a)(iv) of the Transportation of Dangerous Goods Regulations if:

(a) the tanks are not more than 1000 L in capacity, and are designed, constructed, and marked pursuant to the conditions of Permit for Equivalent Level of Safety SH 7131(Ren. 1);

(b) the tanks are periodically inspected, tested, and maintained as though they were TC 51 tanks in accordance with CSA Standard B620-09 "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2009;

CONDITIONS

(c) the tanks are selected and used in accordance with standard CSA B622-09 "Selection and use of highway tanks, TC portable tanks, and ton containers for the transportation of dangerous goods, Class 2", January 2009, cited in the rest of this certificate as CSA B622-09, as though they were TC 51 tanks, except as specified in condition (d) of this certificate;

(d) despite Clause 5.2.4 of CSA B622-09, the filling ratio is not greater than 81.6% and such that the pressure will not exceed the maximum allowable working pressure (MAWP) at 55ºC; and,

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the tanks are marked "SH 9944" in characters at least 50 mm high, in a clearly visible location near the nameplate, and in a color contrasting the background.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to handle, offer for transport and transport SULFUR HEXAFLUORIDE (SF6) in purpose built tanks that were designed, constructed, and marked pursuant to Permit for Equivalent Level of Safety SH 7131 (Ren.1), and are selected, used, inspected, tested, and maintained as though they are TC 51 tanks. The tanks meet all requirements for TC 51 tanks in force at the time of manufacture, except they have a higher maximum allowable working pressure (MAWP) and a pressure relief system that is more suitable for the application. The filling ratio is prescribed because the general provisions of CSA B622-09 do not apply well to SF6 with its relatively low critical point. These tanks will provide a level of safety that is superior to the TC 51 tanks that are authorized in CSA B622-09.
