CONDITIONS

This Equivalency Certificate authorizes Tervita Environmental Services Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN1950, AEROSOLS, flammable, Class 2.1 or UN1950, AEROSOLS, non-flammable, Class 2.2, in a manner that does not comply with clauses 8.1.6, 8.1.7 and 9 b) of standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, incorporated by reference in section 5.11 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are intended for disposal, recycling or any other reclamation process;

(b) the dangerous goods are handled, offered for transport or transported in compliance with section 9 of standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, incorporated by reference in section 5.11 of the Transportation of Dangerous Goods Regulations;

(c) despite clause 9 e) of standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, the dangerous goods in each outer means of containment may be included in divisions 2.1 or 2.2;

CONDITIONS

(d) a means of valve protection is not required;

(e) clause 8.1.7 of standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, does not apply;

(f) for dangerous goods classified as UN1950 with no subsidiary classification, the outer means of containment may have a maximum capacity of 1 500 L;

(g) each outer means of containment with a capacity less than or equal to 450 L is marked with the primary class label and each subsidiary class label, the shipping name, and the UN number, as specified in sections 4.10, 4.11, and 4.12 of Part 4 of the Transportation of Dangerous Goods Regulations;

(h) each outer means of containment, with a capacity over 450 L, is marked with the appropriate safety marks, in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(i) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(j) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 9929 (Ren. 11)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of waste aerosols intended for disposal, recycling or any other reclamation process. The waste aerosols are handled, offered for transport or transported in compliance with section 9 of standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, incorporated by reference in section 5.11 of the Transportation of Dangerous Goods Regulations, except that valve protection is not required, since post-consumer aerosols are mostly missing their caps. Dangerous goods included in divisions 2.1 or 2.2 may be contained in the same outer container.

This Equivalency Certificate also authorizes the transportation of UN1950, AEROSOLS, Class 2.1 with no subsidiary classification or UN1950, AEROSOLS, Class 2.2 with no subsidiary classification, in leakproof outer packagings with a capacity less than or equal to 1 500 L.
