CONDITIONS

This Equivalency Certificate authorizes BASF Canada Inc. and BASF Corporation, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, dangerous goods that are UN3121, OXIDIZING SOLID, WATER-REACTIVE, N.O.S. (activated sodium chlorite), Class 5.1, Packing Group I, in a manner that does not comply with the requirements of subsection 1.5.2(1) of Part 1 (Coming into Force, Repeal, Interpretation, General Provisions and Special Cases) and section 2.4 of Part 2 (Classification) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are handled, offered for transport or transported in accordance with an exemption issued under Subpart B of Part 107 of 49 CFR from a place in the United States to a place in Canada or from a place in the United States through Canada to a place outside Canada and the exemption number appears on the shipping document;

(b) any subsequent offering for transport or transporting of the dangerous goods is in compliance with the Transportation of Dangerous Goods Regulations and the dangerous goods are labeled in accordance with Part 4 (Dangerous Goods Safety Marks) of the Transportation of Dangerous Goods Regulations;

(c) the dangerous goods are packaged in accordance with Packing

Instruction 503 of Transport Canada Standard TP14850E, "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8 and 9, a Transport Canada Standard", 2nd Edition, October 2010;

(d) the total quantity of dangerous goods is less than or equal to 15 kg per outer packaging;

(e) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 9912 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

In Canada, sodium chlorite is classified as UN1479, OXYDIZING SOLID, N.O.S. (activated sodium chlorite), Class 5.1, PG I. In the United States, the classification is UN3121, OXYDIZING SOLID, WATER-REACTIVE, N.O.S. (activated sodium chlorite), Class 5.1, PG I as per US DOT Approval CA2004120003 and Special Permit DOT-SP 15182. This Equivalency Certificate authorizes the transport of UN3121 as per US DOT approval up to the first destination in Canada. Subsequent shipments must be using the UN1479 classification as per the Transportation of Dangerous Goods Regulations.

It is expected that the Transportation of Dangerous Goods Regulations will be modified to reflect the conditions of the Equivalency Certificate.
