CONDITIONS

This Equivalency Certificate authorizes Brenner Tank LLC to handle, offer for transport and transport, and authorizes any person to handle, offer for transport and transport on behalf of the certificate holder, by road vehicle, dangerous goods of Classes 3, 5, 6, and 8 in a manner that does not comply with paragraph 5(c) of the Transportation of Dangerous Goods Act 1992, subsection 5.1(2) and subparagraph 5.14(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the tanks are designed, manufactured, certified, and marked by the certificate holder as DOT406, DOT407, or DOT412 tanks in accordance with the requirements of Title 49 of the Code of Federal Regulations of the United States (49CFR), 2015, except:

(i) despite §178.345-2 of 49CFR, UNS S32003 and UNS S32101 materials not listed in Section II of the ASME Code may be used in accordance with ASME Code Cases 2503 or 2418 respectively, and

(ii) despite the maximum allowable stress values referred to in ASME Code Cases 2503 or 2418, the allowable design stresses shall be such that the design factor is not less than 4:1;

CONDITIONS

(b) the tanks are selected and used in accordance with CSA Standard B621-09 "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, as though they were DOT406, DOT407, or DOT412 tanks;

(c) the tanks are marked "SH 9884" in characters at least 50 mm high, in a clearly visible location on each side near the middle, and in a color contrasting the background.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Brenner Tank LLC and anyone on their behalf to handle, offer for transport or to transport a variety of Dangerous Goods in tanks that meet all requirements of the DOT 406, 407, & 412 specifications in 49CFR except that alternate materials of construction are permitted. Note that the tanks have been designed, constructed, and marked by the applicant as DOT406, DOT407, or DOT412 tanks pursuant to the conditions of US DOT special permit DOT-SP 14467, dated May 10, 2007, and that material thicknesses less than those required in §178.346-2, §178.347-2, and §178.348-2 of 49CFR are not permitted for use in Canada under this Equivalency Certificate.
