CONDITIONS

This Equivalency Certificate authorizes Nova Chemicals Corporation, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods of Classes 3 and 4.3, in a manner that does not comply with section 5.12 of the Transportation of Dangerous Goods Regulations with regard to the selection and use of means of containment, if:

(a) the means of containment are in compliance with the requirements applicable to Specification TC‑4BWM cylinders set out in National Standard of Canada CAN/CSA B339-02, "Cylinders, Spheres and Tubes for the Transportation of Dangerous Goods", October 2002, as amended in November 2003 and February 2005, cited in the rest of this certificate as CAN/CSA B339‑02;

(b) prior to filling, the marking on each cylinder is verified for the date of manufacture and the date of previous requalification. Cylinders are due for requalification and shall not be refilled if 5 years or more have elapsed since manufacture or since the previous requalification;

(c) cylinders due for requalification are requalified in accordance with the basic requirements of Clause 24.2.1 of CAN/CSA B339-02. Cylinder requalification is performed only by a facility registered by Transport Canada under Clause 25 of CAN/CSA B339-02;

CONDITIONS

(d) the level of filling does not exceed 95% of the capacity of the cylinder
at 50°C and the cylinder does not become liquid full at a temperature of 55°C;

(e) the cylinders are used to contain substances that do not corrode or otherwise adversely affect the structural integrity of the cylinders or their accessories; and

(f) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 9862 (Ren. 1)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the certificate holder to transport certain liquid dangerous goods in TC cylindersthat meet the requirements of the Transportation of Dangerous Goods Regulations. This practice was permitted prior to the coming into force of the Clear Language Regulations. Paragraph 4.1.3.6 of the UN Recommendations on the Transport of Dangerous Goods, 15th Revised Edition, allows the use of cylinders approved by the Competent Authority for these dangerous goods. The conditions of this certificate with regard to the means of containment are consistent with the requirements of the UN Recommendations. The requalification of the cylinders includes an internal visual inspection, as some of the dangerous goods may be corrosive to steel. We expect the applicable safety standards to allow this practice once they are amended to reflect the requirements of the UN Recommendations.
