CONDITIONS

This Equivalency Certificate authorizes Orica Canada Inc., to handle, offer for transport and transport, and authorizes any person to handle, or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN0332, EXPLOSIVE, BLASTING, TYPE E, Class 1.5D, Packing Group II, in a manner that does not comply with sections 5.1 and 5.8 of the Transportation of Dangerous Goods Regulations with regards to the packaging requirements set out in the CGSB 43.151-2012 "Packing, handling, offering for transport and transport of Explosives (Class 1)", October 2012, if:

(a) the dangerous goods are transported in residual amount in a portable tank;

(b) the portable tank is licensed by the Explosives Regulatory Division of Natural Resources Canada as a fixed process tank;

(c) all access hatches, cabinets, accessible manholes, and piping outlets are closed and locked in transport;

(d) the portable tank has been substantially decontaminated of its explosives content, including thoroughly emptying the tank, pigging loading hoses and accessible piping, and scraping and washing all accessible surfaces;

(e) the net explosive quantity of explosives contained in one portable tank is less than or equal to 25 kg;

(f) the portable tank displays a visible and legible tag indicating that it is contaminated with explosives;

(g) the portable tank is secured to the means of transport in accordance with the National Safety Code (NSC) for Motor Carriers, NSC Standard 10 "Cargo Securement", September 2004; and

(h) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport portable tanks that are contaminated by an explosive composition used as a blasting agent. The portable tanks have been equipped with a pumping system to dispense the explosives and a heating system to keep the explosive pumpable in cold weather. The portable tanks are also insulated and covered by an external jacket. Most of the remaining explosive emulsion or slurry is contained inside the pump cavities and associated piping. The storage tank is transported from mining or quarrying sites lacking the technical capability and regulatory approval for complete decontamination to another site licensed for explosive storage by the Explosives Regulatory Division of Natural Resources Canada (ERD).

The equipment is licensed by ERD as a "fixed process" tank to handle explosive emulsion or slurry, and is thus fit for that purpose. The conditions set out in this certificate and the small quantity of dangerous goods per portable tank ensure a level of safety that is consistent with the level of safety reached with the same quantity of explosive composition packaged in accordance with the safety standards prescribed by the TDG Regulations. The level of safety is not affected.
