CONDITIONS

1. This Equivalency Certificate authorizes Interstate Battery System of America Inc., Interstate Battery System of Canada Inc. and the Companies listed in Appendix A of this certificate, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are:

  • UN2794, BATTERIES, WET, FILLED WITH ACID, electric storage, Class 8,
  • UN2795, BATTERIES, WET, FILLED WITH ALKALI, electric storage, Class 8, or
  • UN2800, BATTERIES, WET, NON-SPILLABLE, electric storage, Class 8,

in a manner that does not comply with sections 4.15 and 4.15.3, subsection 5.1(1), and section 5.14 of theTransportation of Dangerous Goods Regulations, under the following conditions:

CONDITIONS

(a) the dangerous goods are handled, offered for transport or transported in compliance with Packing Instruction 801 of Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010, cited in the rest of this certificate as TP14850E;

(b) in addition to the means of containment prescribed in section 2 of the Packing Instruction 801 of TP14850E, used storage batteries may be transported loose in rigid, leak proof means of containment made of materials compatible with the contents of the batteries. When these conditions are met, sections 3, 4, 5, and 6 of Packing Instruction 801 of TP14850E do not apply;

(c) the rigid container, wooden slatted crate or pallet with a capacity exceeding 450 L has displayed on two opposite sides the safety marks required by sections 4.10, 4.11, and 4.12 of the Transportation of Dangerous Goods Regulations;

(d) the road or railway vehicle used to transport the dangerous goods has safety marks displayed on it in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

CONDITIONS

2. This Equivalency Certificate authorizes Interstate Battery System of America Inc., Interstate Battery System of Canada Inc. and the Companies listed in Appendix A of this certificate, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are:

  • UN2794, BATTERIES, WET, FILLED WITH ACID, electric storage, Class 8,
  • UN2795, BATTERIES, WET, FILLED WITH ALKALI, electric storage, Class 8, or
  • UN2800, BATTERIES, WET, NON-SPILLABLE, electric storage, Class 8,

in a manner that does not comply with subsection 5.1(1) and section 5.14 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods may be transported on shelves, which are permanently fixed and secured to the means of transport;

(b) the dangerous goods are loaded and secured on the shelves as to prevent damage, short circuits, and inadvertent movement so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(c) the battery terminals must not support the weight of other superimposed elements;

(d) the road vehicle used to transport the dangerous goods has safety marks displayed on it in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 9822 (Ren. 4)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport dangerous goods that are:
