CONDITIONS

This Equivalency Certificate authorizes Amtrol-Alfa Metalomecânica, S.A., to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(i) and 5.10(1)(b)(i), paragraph 5.10(1)(c), subparagraph 5.10(1)(d)(i), and subsections 5.10(2) and 5.10(5) of the Transportation of Dangerous Goods Regulations, if:

(a) subject to conditions (b) to (f), the requirements applicable to Specification TC‑4BAM cylinders in CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, and cited in the rest of this certificate as CSA B340-08, are complied with;

CONDITIONS

(c) cylinders that have been subjected to excessive heat or fire are not returned to service;

(d) not more than 15 years has elapsed since the original manufacturing test date for each cylinder;

(e) instead of the standards of inspection specified in Clause 5.1.3(c) of CSA B340-08, the visual inspection requirements specified in condition (s) of this certificate apply;

(f) despite Clause 5.1.4(b) of CSA B340-08, before being filled, cylinders due for requalification are requalified in accordance with the requirements specified in condition (s) of this certificate. Cylinders that do not meet the prefill inspection shall be rejected and not filled until the cause for rejection has been corrected;

Manufacture and Requalification

(g) the cylinders are manufactured at Amtrol-Alfa Metalomecânica, S.A., Guimarães, Portugal, in accordance with the specific procedures, the design qualification test reports, and drawing numbers H022-04-0012-C, H013-04-0016C and H013-04-0017-C, all filed with the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada in September 2008 and October 2008, by Amtrol-Alfa Metalomecânica, S.A.;

(h) subject to conditions (i) to (r), the cylinders are in compliance with the requirements applicable to fully wrapped composite cylinders with load-sharing liners specified in ISO standard 11119‑2, "Gas cylinders of composite construction - Specification and test methods - Part 2: Fully wrapped fibre reinforced composite gas cylinders with load-sharing metal liners", dated 2002, cited in the rest of the certificate as ISO 11119-2:2002;

(i) the liner is a welded steel liner manufactured in accordance with the design requirements filed with the Director by the manufacturer and used to manufacture the cylinders for prototype testing;

CONDITIONS

(j) weld procedures and operators are qualified in accordance with the applicable requirements of CGA Publication C-3 "Standards for Welding on Thin Walled Steel Cylinders - Seventh Edition", dated 2005;

(k) the composition of the steel authorized is limited to cold rolled steel sheet designation DDS of ASTM Standard A 1008/A 1008M-01a "Standard Specification for Steel, Sheet, Cold-Rolled, Carbon, Structural, High-Strength Low-Alloy and High-Strength Low-Alloy with Improved Formability",

dated 2001;

(l) the filament materials are composed of pre-impregnated glass fibre, having a minimum strand strength and other mechanical properties as specified for each cylinder design by the cylinder manufacturer;

(m) inspections and verifications are in accordance with the requirements of ISO 11119-2:2002 and carried out by an Independent Inspector registered with Transport Canada in accordance with Clause 25.4 of CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, cited in the rest of the certificate as CSA B339-08. In addition, the Independent Inspector:

(i) performs or witnesses the burst test, drop test, high velocity impact (gunfire) test, fire resistance test and torque test,

(ii) for each cylinder batch, prepares a report that includes, at a minimum, all information shown in Annex B of ISO 11119-2:2002. The reports are retained by the manufacturer and by the Independent Inspector for the service life of the cylinders, and

(iii) for inspection of the liners, complies with the inspection requirements for welded cylinders of CGA Publication C-11, "Recommended Practices for Inspection of Compressed Gas Cylinders at Time of Manufacture",
dated 2006;

CONDITIONS

(n) the proof pressure test specified in Clause 8.5.1 of ISO 11119-2:2002 is performed hydraulically or pneumatically. The test system components and test system accuracy verification comply with Compressed Gas Association Publication C-1, "Methods for Hydrostatic Testing of Compressed Gas Cylinders", dated 2006;

(o) the burst test specified in Clause 8.5.4 of ISO 11119-2:2002 is performed and the cylinder remains in one piece;

(p) the mechanical tests specified in Clause 9.1.3 of ISO 11119-2-2002 are performed in accordance with the requirements specified in Clauses 9.1.1.1, 9.1.2.1, 9.1.2.2.1.1, 9.1.2.2.2, and 9.1.2.3 of ISO 4706, "Gas cylinders -- Refillable welded steel cylinders -- Test pressure 60 bar and below",
dated 2008;

(q) the requirements specified in Clauses 4.3, 4.4, and 4.14 of CSA B339-08 apply;

(r) each cylinder is permanently marked in accordance with Clause 4.18 of

CSA B339-08, except the Transport Canada mark, the specification designation and the service pressure are replaced with "TC-SU 9768" followed by the service pressure expressed in bar. In addition to these marks, each cylinder must be permanently and legibly marked with:

(i) the letter "T" followed by the tare (in kilograms) and the unit symbol "kg",

(ii) the text "requalification required 5 years from date of manufacture / requalification requise 5 ans après la date de fabrication",

(iii) the text "cylinder service life expires 15 years from date of manufacture/ durée de vie de la bouteille à gaz vient à échéance 15 ans après sa date de fabrication", and

(iv) when the lading is propane, the text "Max Propane" followed by the maximum mass of propane (in kilograms) and the unit symbol "kg";

(s) each cylinder is requalified at least every five years in accordance with the following conditions:

(i) the requalification is performed by a facility registered for requalifying cylinders in accordance with Clause 25.3 of CSA B339-08,

CONDITIONS

(ii) the outer casing is not removed from the cylinder. Removal or replacement of the outer casing is not authorized,

(iii) a visual inspection is conducted on the outer casing in accordance with Appendix A of this certificate,

(iv) an internal visual inspection is conducted in accordance with the requirements of CGA Publication C-6 "Standards for Visual Inspection of Steel Compressed Gas Cylinders", dated 2007,

(v) for cylinders used in recycled or recovered refrigerant gas service, a proof pressure retest is conducted in accordance with the requirements of CGA Publication C-1 "Methods for Pressure Testing Compressed Gas Cylinders", dated 2009,

(vi) a requalification marking is applied in accordance with Clause 24.6.3 of CSA B339-08. The marking is applied on a label securely affixed to the part of the outer casing protected by the handles or the marking is engraved or stamped on the outer casing, and

(vii) the requalification report is kept for the service life of the cylinder. The report shall include, as a minimum, the inspection results for each type of damage described in CGA C-6 or Appendix A of this certificate. The owner of the cylinder and the person who prepared the report shall each keep a copy of the report for the service life of the cylinder;

(t) the certificate holder reports any incident involving loss of contents or failure of the cylinders to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada; and

This Equivalency Certificate serves as the registration of Amtrol-Alfa Metalomecânica, S.A., pursuant to Clause 25.2 of CSA B339-08, to manufacture cylinders of the designs specified herein. Amtrol-Alfa Metalomecânica, S.A.'s registered mark, pursuant to CSA B339-08, is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The certificate holder has demonstrated that the manufacture of a cylinder in accordance with Standard ISO 11119-2:2002 and the conditions specified results in a cylinder which could be used with equivalent safety to that of a TC‑3FCM specification cylinder. This Certificate authorizes the manufacture and use of these cylinders under the Transportation of Dangerous Goods Regulations.

NOTE

Under Canadian Law, a foreign manufacturer of non-specification cylinders cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the means of containment an offence (subsection 31(6)).

If none of the foregoing are adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).

Cylinders shall be carefully inspected for abrasion damage. Minor abrasion damage to the protective outer jacket that does not affect the integrity, nor the ease of handling, of the cylinder is acceptable. Any cylinder that shows evidence of major abrasion damage that creates sharp edges on the outer jacket, fully penetrates the outer casing, reduces its ease of handling, or decreases its integrity, shall be condemned.

Cylinders shall be carefully inspected for evidence of exposure to fire or overpressurization, including bulging. Any cylinder showing evidence of heat, fire or overpressurization damage, including but not limited to discoloration, charring, distortion, bulging or melting, shall be condemned.

Chemical attack damage

Cylinders shall be carefully inspected for evidence of exposure to chemicals. Any cylinder showing discoloration, dissolved plastic, or any other sign of chemical attack shall be condemned.

Cuts and gouges

Cylinders shall be carefully inspected for cuts and gouges. Any cylinder with a cut or gouge that fully penetrates the protective outer jacket shall be condemned.
