CONDITIONS

This Equivalency Certificate authorizes Kitnuna Petroleum Ltd., to handle, offer for transport or transport, by road vehicle only, dangerous goods that are UN1203, GASOLINE, Class 3, Packing Group II, UN1202, DIESEL FUEL, GAS OIL, or HEATING OIL LIGHT, Class 3, Packing Group III, or UN1863, FUEL, AVIATION, TURBINE ENGINE, Class 3, Packing Group II or III, in a manner that does not comply with subsection 5.1(2) and subparagraph 5.14(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the tanks are selected and used in accordance with the requirements of CSA Standard B621-09 "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, except for the periodic inspection and test intervals for tanks in Table 7.1 of Clause 7, and for hose assemblies in Clauses 7.2.10.4 and 7.2.10.5 of CSA B620-09 "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2009, cited in the rest of this certificate as CSA B620-09;

CONDITIONS

(b) the tanks are subjected to an external visual inspection and leakage test pursuant to Clauses 7.2.1 and 7.2.5 and marked pursuant to Clause 7.4 of

CSA B620-09 every 3rd and 5th year, by a facility registered for that purpose pursuant to Clause 8 of CSA B620‑09;

(c) the tanks are subjected to a pressure test pursuant to Clause 7.2.7, and marked pursuant to Clause 7.4 of CSA B620-09 every 5 years by a facility registered for that purpose pursuant to Clause 8 of CSA B620-09;

(d) hose assemblies are inspected, tested, and marked pursuant to Clause 7.2.10 of CSA B620-09 every 3rd and 5th year, by a registered facility referred to in conditions (b) and (c) of this certificate;

(e) each subsequent visual inspection, leakage test, hose inspection and hose test referred to in conditions (b) and (d) of this certificate is completed within 3 years of the last pressure test referred to in condition (c) of this certificate, or within 2 years of the last visual inspection and leakage test referred to in condition (b) of this certificate, whichever is last;

(f) each subsequent pressure test is completed within 5 years of the last pressure test referred to in condition (c) of this certificate;

(g) the tanks are marked with the characters "SH 9548" not less than 32 mm high, near the certification plate where they will be clearly visible from the ground;

(h) non-specification tanks have been removed from service before January 1, 2010;

(i) the applicant provides an update to the list in Appendix A of this certificate to the Regional Manager, Transportation of Dangerous Goods, Transport Canada Winnipeg Office, by fax at 204-983-8992 and also to the Chief, Permits and Approvals, Regulatory Affairs, Transportation of Dangerous Goods Directorate, by email (tdgapprovals-approbationstmd@tc.gc.ca) or by fax at 613-993-5925 no later than December 31st annually; and

CONDITIONS

(j) each tank is operated only within the community of Cambridge Bay, Nunavut, except when moved for inspection, maintenance, repair, or disposal.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Kitnuna Petroleum Ltd., to use fuel delivery tank trucks that have not been inspected and tested in accordance with CSA B620, at the designated inaccessible remote location in Nunavut. The tanks are instead visually inspected and leak tested every 3rd and 5th year, and pressure tested every 5th year by a CSA B620 registered facility. Hose assemblies are inspected and tested with the same frequency as the tank visual inspections.
