CONDITIONS

This Equivalency Certificate authorizes Proserv UK Limited to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by cargo aircraft or by ship, means of containments in a manner that does not comply with subsections 5.1(1) and 5.1(2), section 5.2, subparagraphs 5.10(1)(a)(ii), 5.10(1)(b)(iii), 5.10(1)(c)(ii), and 5.10(1)(d)(iii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) subject to conditions (b) to (h) of this certificate, the requirements applicable to specification TC‑3ASM means of containments in CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, cited in the rest of this certificate as CSA B340-08, are complied with;

(b) the means of containments are used for hydrocarbon well sampling services only;

CONDITIONS

(c) subject to condition (d) of this certificate, the means of containments contain only the following dangerous goods:

UN1953 Compressed gas, toxic, flammable, n.o.s.

UN1954 Compressed gas, flammable, n.o.s.

UN1964 Hydrocarbon gas MIXTURE, compressed, N.O.S.

UN1965 Hydrocarbon gas mixture, liquefied, n.o.s.

(d) means of containments filled with UN1953, compressed gas, toxic, flammable, n.o.s., are not transported by aircraft;

(e) despite the requirements of Clause 4.3.1 of CSA B340-08, the means of containments are not equipped with pressure-relief devices. However, when subjected to a fire test in accordance with CGA Publication C-14-1999, "Procedures for Fire Testing of DOT Means of containment Pressure Relief Device Systems", Third Edition, published by the Compressed Gas Association, Inc., the means of containments vent due to seal failure and do not rupture;

(f) before filling, each means of containment is inspected in accordance with CSA B340-08 and in accordance with Proserv UK Limited's guidelines for maintenance, inspection, and cleaning. Any means of containment with damage to its shell that reduces the wall thickness to less than the minimum design wall thickness is condemned. Any repair to a valve or accessory is carried out by personnel trained for that purpose;

(g) for transport and handling, each means of containment is fitted with valve protectors and each valve port is fitted with an appropriate plug;

(h) each means of containment, complete with valve protectors, is transported in a strong outside packaging in accordance with Proserv UK Limited's drawing number 851163 "Universal Transportation Box to Accommodate All Means of containment Types";

CONDITIONS

(i) subject to conditions (j) to (w) of this certificate, the means of containments are in compliance with the requirements applicable to Specification TC-3ASM set out in CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, cited in the rest of this certificate as CSA B339-08;

(j) the means of containments are manufactured and assembled at 4 Greenbank Place, East Tullos, Aberdeen, Scotland, UK, or prior to February 2, 2012 were manufactured and assembled at Riverside, North Esplanade West, Aberdeen, Scotland, UK, in accordance with the procedures, specifications, and the drawings for the Type 5 Universal Hydrocarbon Sample Means of containment or the Type 6 Single Phase Sample Means of containment listed in Table 1 of Appendix A of this certificate, filed by Proserv (North Sea) Limited on October 5, 2006, by Proserv UK Limited on December 3, 2009 and August 13, 2012, in accordance with the revised specifications filed by Proserv UK Limited on March 5, 2008 with Transport Canada's Transportation of Dangerous Goods Directorate;

(k) the means of containments are hydrocarbon well sampling means of containments, manufactured from stainless steel billets, with screwed ends. Each means of containment is equipped with a floating piston assembly designed to separate the hydrocarbon well sample end from the pressurization end;

(l) subject to condition (m) of this certificate, the means of containment shells and ends are manufactured from Armco 17-4 PH precipitation-hardening stainless steel, double hardened at 621°C (1150°F). The material meets the requirements specified in National Association of Corrosion Engineers (NACE) Standard MR0175, "Petroleum and natural gas industries - Materials for use in H2S-containing environments in oil and gas production", published in 2003;

(m) a coating may be applied to the internal surfaces of means of containments in accordance with the procedures and specifications filed by Proserv UK Limited on June 9, 2008 with Transport Canada's Transportation of Dangerous Goods Directorate. The coating application process shall be carried out by Bodycote Metallurgical Coatings Ltd., Macclesfield, Cheshire, UK, and the means of containments shall not be subjected to temperatures exceeding 427°C during the process;

(n) the minimum wall thickness for each means of containment is specified in Table 1 of Appendix A of this certificate, and the maximum wall stress of 235 MPa specified in item 5.3.1(a)(iii) of CSA B339-08, does not apply;

CONDITIONS

(o) despite the requirements of Clause 4.3.5 of CSA B339-08, the calculated shear strength of the end cap threads is at least 5 times the shear stress at the test pressure of the means of containments, and the threads do no fail before the means of containment ruptures;

(p) despite the requirements of Clause 5.7 of CSA B339-08, the completed means of containments are not heat-treated;

(q) despite the requirements of Clause 5.8 of CSA B339-08, a tensile test is not required for each lot of completed means of containments provided that the tensile properties are determined from a sample taken from each heat of Armco 17-4 PH bar material representing each lot of 200 means of containments or less, and the minimum tensile strength is 931 MPa, the minimum yield strength is 724 MPa, and the minimum elongation is 16% for a Type D specimen;

(r) despite the requirements of Clause 5.9 of CSA B339-08, a flattening test is not required on a representative means of containment;

(s) each means of containment is tested hydrostatically to its test pressure and has its volumetric expansion measured;

(t) subject to condition (u) of this certificate, the Transport Canada mark, the specification designation, and the service pressure marked on each means of containment is:

followed by the service pressure expressed in bar;

(u) the markings are electro-etched on the designated area of the means of containment as shown on Proserv UK Limited's marking drawing 851144, 850870-10, 851145 or 850867 filed on July 29, 2008, marking drawing 850870‑9-1000 filed on December 3, 2009, and marking drawing 851144-960, 851145-990, or 850867-990 filed August 13, 2012, with the Transportation of Dangerous Goods Directorate. The markings are at least 6 mm in height;

(v) despite Clause 4.14.5 of CSA B339-08, for qualification of a new design, means of containments are hydrostatically tested to at least 2.25 times the service pressure and do not burst, but leak due to seal failure at the end closures;

CONDITIONS

(w) despite the provisions of Clause 24.2.1.6 of CSA B339-08, each means of containment is requalified by Proserv UK Limited or by Authorized Testing Inc., Riverside, California, USA, in accordance with the requirements in Clause 24 of CSA B339-08. The requalification period is five years; and

(x) the certificate holder, the means of containment owner, or the user reports any incident involving loss of contents or failure of the means of containment to the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada.

This Equivalency Certificate serves as the registration of Proserv UK Limited, pursuant to Clause 25.2 of CSA B339-08, to manufacture means of containments of the designs specified herein. Proserv UK Limited's registered mark, pursuant to CSA B339‑08, is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the ICAO Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the manufacture and use of hydrocarbon well sampling means of containments designed for use in the oil and gas industry. The certificate holder has demonstrated that when manufactured under the conditions stipulated herein, the means of containment could be used with equivalent safety.

NOTE

Under Canadian Law, a foreign manufacturer of non-specification means of containments cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the means of containments an offence (subsection 31(6)).

If none of the foregoing are adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).
