CONDITIONS

This Equivalency Certificate authorizes ISGEC Heavy Engineering Ltd., to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, or by ship on a domestic voyage, ton containers, in a manner that does not comply with sections 5.1, 5.2, and 5.5 and paragraphs 5.10(1)(a), 5.10(1)(b), and 5.10(1)(d) of the Transportation of Dangerous Goods Regulations, if:

(a) subject to condition (b) of this certificate, the requirements applicable to ton container specification TC 106A500X in Transport Canada standard TP14877E, "Containers for Transport of Dangerous Goods by Rail", December 2013, cited in the rest of the certificate as TP14877, are complied with;

CONDITIONS

Note 1: The minimum outage is 1% of the total volumetric capacity of the ton container at a product reference temperature of 46.1oC (115oF).

Note 2: The minimum outage is 5% of the total volumetric capacity of the ton container at a product reference temperature of 46.1oC (115oF).

(c) the ton containers are manufactured at the Yamuna Nagar, Haryana, India manufacturing facility in accordance with drawing number PV-01-1592 Rev 5, models D1, D2 or D3, and the specific procedures, and additional information filed by ISGEC Heavy Engineering Ltd.;

(d) except as noted in conditions (e) to (k) of this certificate, the ton containers are in compliance with all the requirements applicable to Specification TC 106A500X set out in TP14877;

(e) the circumferential joints between the heads and shell are fusion welded instead of forge-welded;

(f) the circumferential joints between the heads and shell of each ton container produced are fully radiographed;

(g) the ends of each ton container are crimped inwardly towards the centerline at least 25 mm (1 in.) on the radius;

(h) as a minimum the following information is plainly and permanently stamped in letters and figures having a height of 10 mm (3/8 in.) into the metal of the valve end chime of each ton container:

1 - TC SU 8722/34.47 BAR or when warranted

TC SU 8722/DOT SP‑12277/34.47 BAR

2 - Tank material followed by water capacity

3 - M-0201 followed by the serial number

4 - Independent Inspector's mark followed by original test date (month & year);

(i) the tare weight is marked either by stamping on the metal of the valve end chime of each ton container or by stamping on a metal plate secured to one of the ton container heads;

(j) the reports are retained by the manufacturer and by the independent inspector for a minimum of 15 years;

CONDITIONS

(k) the maximum requalification period is 5 years, and the inspections and tests are performed in accordance with the requirements of clause 9.9 of TP14877E, applicable to specification 106A500X. The inspections and tests are performed at a test facility registered with the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada or authorized by the US Department of Transportation for such requalification;

(l) the certificate holder reports any incident involving loss of contents or failure of the ton containers to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada; and

(m) before the expiry date of this certificate, the certificate holder reports a summary of the manufacturing and performance experience to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the manufacture and use of specially designed ton containers for the transportation of various gases. The design, inspection, manufacture, requalification and selection and use of these ton containers conform to the requirements of a TC specification 106A500X ton container in TP14877, with the exception of the circumferential joint which is performed by fusion welding instead of forging.
