CONDITIONS

This Equivalency Certificate authorizes Linde Canada Ltd., to handle, offer for transport, transport, or import, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN3306, Compressed Gas, Toxic, Oxidizing, Corrosive, N.O.S., Class 2.3(5.1)(8), in a manner that does not comply with Special Provision 38 of Schedule 2, subsection 5.1(1) and subparagraph 5.10(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if

(a) the means of containment are tubes manufactured in accordance with:

(i) specification TC-3AAXM set out in CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008,

CONDITIONS

(ii) the requirements of the regulations for the transportation of dangerous goods by rail in force before December 5, 1991, and each tube has displayed on it the letters "CRC", "BTC", or "CTC", followed by the marks "3AAX", or

(iii) where the initial test date of the tube is December 31, 1992 or earlier,

Part 178 of Title 49 of the Code of Federal Regulations of the United States, and each tube has displayed on it the letters "ICC" or "DOT", followed by the marks"3AAX";

(b) each tube manufactured in accordance with subparagraph (a)(i) has a minimum service pressure of 184 bar and each tube manufactured in accordance with subparagraphs (a)(ii) or (a)(iii) has a minimum service pressure of 2400 psi;

(c) subject to paragraphs (d) to (f), the requirements with respect to specification TC-3AAXM tubes CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, and cited in the rest of this certificate as CSA B340-08, are complied with;

(d) each tube is filled with no more than 100 kg fluorine in the form of a gas mixture composed of 20% fluorine and 80% nitrogen, by volume;

(e) the tubes are manifolded in accordance with clause 4.4 of CSA B340-08 and the manifolded piping is equipped with a manual shut-off valve suitable for fluorine/nitrogen service having a leak-tight cap in the valve outlet at the termination of the piping;

(f) pressure-relief devices are not required; however, where a tube is equipped with pressure-relief devices, those devices are in accordance with CGA Publication S-7, Method for Selecting Pressure Relief Devices for Compressed Gas Mixtures in Cylinders, published in 2005 by the Compressed Gas Association, Inc.; and

(g) where the tubes are affixed to a trailer chassis, an exterior tube as well as the rear trailer cabinet is marked with the letters and numbers "TC-SH 8574" in characters of a colour contrasting with the background, at least 50 mm in height.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transport of a 20% mixture of fluorine in nitrogen in manifolded tubes mounted on a vehicle (tube trailer). The certificate holder has demonstrated that when selected and used under the conditions stipulated herein, the tubes could be used with equivalent safety.
