CONDITIONS

1. This Equivalency Certificate authorizes the members of The North American Automotive HazMat Action Committee (NAAHAC) to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the members of The North American Automotive HazMat Action Committee (NAAHAC), by road or railway vehicle, dangerous goods that are UN3268, SAFETY DEVICES, electrically initiated, Class 9, in a manner that does not comply with subsection 5.12(1), subparagraphs 5.14(1)(a)(i) and 5.14(1)(b)(i) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods contained in a means of containment having a capacity less than or equal to 450 L are transported in accordance with Packing Instructions 902 of the Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010, and are contained in one of the following UN specification means of containment:

(i) drums (1A2, 1B2, 1N2, 1H2, 1D, 1G),

(ii) boxes (4A, 4B, 4N, 4C1, 4C2, 4D, 4F, 4G, 4H1, 4H2),

(iii)jerricans (3A2, 3B2, 3H2),

The means of containment must conform to the Packing Group III performance level;

CONDITIONS

(b) the dangerous goods contained in a means of containment having a capacity over 450 L are transported in accordancewith Packing Instruction LP 902 of the Recommendations on the transport of dangerous goods - Model Regulations, and are contained in one of the following UN specification rigid large means of containment:

(i) steel (50A),

(ii) aluminum (50B),

(iii) metal other than steel or aluminum (50N),

(iv) rigid plastics (50H),

(v) natural wood (50C),

(vi) plywood (50D),

(vii) reconstituted wood (50F),

(viii)rigid fibreboard (50G),

The means of containment must conform to the Packing Group III performance level;

(c) the means of containment must be designed and constructed to prevent movement of the articles and inadvertent operation during normal conditions of transport;

(d) the dangerous goods may also be handled, offered for transport or transported unpackaged in a dedicated handling device, vehicle, container or wagon if the dangerous goods are moved from the place of manufacture to an assembly plant or to, between, and from intermediate handling locations;

(e) the North American Automotive HazMat Action Committee (NAAHAC) ensures that a copy of this Equivalency Certificate is provided to all members of The North American Automotive HazMat Action Committee (NAAHAC);

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the members of The North American Automotive HazMat Action Committee (NAAHAC) ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

CONDITIONS

(g) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 8424 (Ren. 10)"

2. This Equivalency Certificate authorizes the members of the North American Automotive HazMat Action Committee (NAAHAC) to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the members of the North American Automotive HazMat Action Committee (NAAHAC), by road vehicle, dangerous goods that are UN3268, SAFETY DEVICES, electrically initiated, Class 9, in a manner that does not comply with sections 5.1 and 5.12 of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods and its packaging are intended for disposal, recycling or other reclamation process;

(b) the dangerous goods are packaged in,

(i) a steel drum that:

(1) has a water capacity equal to or less than 208 L, has a bottom, wall and lid thickness of not less than 1 mm,

(2) has a closure device that is designed and applied to remain secure during normal conditions of transport,

(3) is adequately ventilated to prevent the build-up of pressure in the event of an airbag module, airbag inflator or seat belt pretensioner activating during transport, including handling,

(4) if used, is dry and free of contamination. The used drum shall show no visual evidence of significant reduction in parent metal thickness, gauges, cracks or other significant defects. Labels and liners must be removed prior to re-use,

(5) is not filled more than 50% of its maximum capacity, or

(ii) inner receptacles that are anti-static plastic bags placed in a robust dedicated reusable container fitted with trays or racks and/or cushioning material preventing the articles to move during transport;

(c) the means of containment is designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of dangerous goods that could endanger public safety;

(d) the North American Automotive HazMat Action Committee (NAAHAC) ensures that a copy of this Equivalency Certificate is provided to all members of the the North American Automotive HazMat Action Committee (NAAHAC);

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the members of the North American Automotive HazMat Action Committee (NAAHAC) ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the shipping document that accompanies the dangerous goods includes the following information:

"Equivalency Certificate No. SU 8424 (Ren. 10)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

Part 1 of this Equivalency Certificate authorizes the transportation of dangerous goods UN3268 in accordance with Packing Instructions 902 of the Transport Canada Standard TP14850E "Small Containers for Transport of Dangerous Goods, Classes 3, 4, 5, 6.1, 8, and 9, a Transport Canada Standard", 2nd Edition, October 2010, for small means of containment, or in accordance with Packing Instruction LP 902 of the Recommendations on the transport of dangerous goods - Model Regulations, for large means of containment with a capacity over 450 L. The Equivalency Certificate authorizes also the handling, offering for transport or transporting of dangerous goods UN3268 in a dedicated handling device, vehicle, container or wagon if the dangerous goods are moved from the place of manufacture to an assembly plant or to, between, and from intermediate handling locations.

Part 2 of this Equivalency Certificate authorizes the use of 208 L or less removable head drums to transport non-refillable cylinders with UN3268, SAFETY DEVICES, electrically initiated, Class 9, to a facility for recycling or disposal.
