CONDITIONS

This Equivalency Certificate authorizes Pressure Vessel Technologies Inc.,

to sell, offer for sale, distribute, and deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(ii), 5.10(1)(b)(iii), 5.10(1)(c)(ii), and 5.10(1)(d)(iii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) the requirements applicable to Specification TC-3EM cylinders in CSA B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, are complied with;

CONDITIONS

Manufacture

(b) the cylinders were manufactured prior to 2005 at 27720-27800 College Park Drive, Warren, MI, U.S.A., in accordance with the specific procedures of the design qualification test report and part number PB-12A or PB-14A filed by Pressure Vessel Technologies, Inc.;

(c) subject to conditions (d) to (i), the cylinders are in compliance with the requirements applicable to Specification TC-3EM set out in CSA B339-02, "Cylinders, Spheres, and Tubes for the Transportation of Dangerous Goods", October 2002, as amended in November 2003 and February 2005, cited in the rest of the certificate as CSA B339-02;

(d) the cylinders have a nominal outside diameter of 63.5 mm, a maximum outside diameter of 64.0 mm, and a maximum length of 305 mm;

(e) the requirement of CSA-B339-02, clause 8.5 that the cylinder shall be manufactured from seamless tubing does not apply;

(f) each cylinder is manufactured from cold drawing of steel plate;

(g) the minimum wall thickness of the cylindrical shell (sidewall) is 1.4 mm;

(h) a flattening test is performed on one cylinder from each lot of 500 or less, in accordance with clause 4.10 of CSA-B339-02, to 6 times the wall thickness without cracking. If the cylinder fails the test, the lot is rejected;

(i) the Transport Canada mark, the specification designation, and the service pressure marked on each cylinder is: "TC - SU 7662 - 124";

CONDITIONS

(j) the documents referred to in clause 4.18 of CSA-B339-02 are retained by the manufacturer and by the Inspector, as defined in that standard, for the service life of the cylinders;

(k) the certificate holder reports any incident involving loss of contents or failure of the cylinders to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada;

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the continued use of cylinders that were manufactured based on Specification TC-3EM, with increased outer diameter. The certificate holder has demonstrated that when manufactured under the conditions stipulated herein, the cylinder could be used with equivalent safety.
