CONDITIONS

This Equivalency Certificate authorizes ArcelorMittal Dofasco G.P. / ArcelorMittal Dofasco S.E.N.C., to handle, offer for transport or transport, by road vehicle, between two properties owned or leased by Dofasco Inc., dangerous goods that are UN3258, ELEVATED TEMPERATURE SOLID, N.O.S., at or above 240°C, Class 9, Packing Group III, in a manner that does not comply with section 4.9 of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported, in the City of Hamilton, Ontario, for a distance not exceeding 3 km from:

(i) Gate 15, south along Ottawa Street to Gate 6 or Gate 8,

(ii Gate 15, south along Ottawa Street and east along Beach Road to Gate 9 or Gate 12,

(iii) Gate 11, south along Kenilworth Avenue to Gate 12,

(iv) Gate 11, south along Kenilworth avenue, then west along Beach Road to Gate 9;

CONDITIONS

(b) the local police is advised, in writing, of the nature of the dangerous goods no more than 12 months in advance of the movement referred to in condition (a) of this certificate;

(c) the vehicle, used in a dedicated service during the transportation of the dangerous goods, displays, on each side and each end of the vehicle, a placard that corresponds to the Class 9 placard set out in Part 4, Appendix: Illustration of Dangerous Goods Safety Marks of the Transportation of Dangerous Goods Regulations;

(d) the placards referred to in condition (c) of this certificate can remain permanently displayed, at all times, on the vehicle used in dedicated service during the transportation of the dangerous goods;

(e) the dangerous goods are secured to the means of transport so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety; and

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(g) the document that accompanies the dangerous goods contains the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 7641 (Ren. 7)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows ArcelorMittal Dofasco G.P. / ArcelorMittal Dofasco S.E.N.C., to transport dangerous goods between their two properties with a permanent Class 9 placard on the vehicles. The short distance travelled and safety concern when the dangerous goods are being loaded and unloaded, on the vehicles, has resulted in the issuance of an Equivalency Certificate.
