CONDITIONS

This Equivalency Certificate authorizes the City of Regina, Fleet Services Department to handle or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle or by ship on a domestic voyage, dangerous goods that are:

· UN1263, PAINT, Class 3, Packing Groups II and III,

· UN1294, TOLUENE, Class 3, Packing Group II,

· UN1993, FLAMMABLE LIQUID, N.O.S. (Toluene), Class 3, Packing Group II, and

· UN1090, ACETONE, Class 3, Packing Group II,

in a manner that does not comply with subsection 5.12(1), and paragraphs 5.14(1)(a) and 5.14(1)(d) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported on a road vehicle that is to be used for marking or painting the road surface;

CONDITIONS

(b) the dangerous goods are in a means of containment that is designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(c) the road vehicle is:

(i) accompanied by an escort vehicle, or

(ii) equipped with fire suppression materials sufficient to respond to a fire;

(d) all provincial operating procedures are complied with; and

(e) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 7137 (Ren. 7)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The road vehicles referred to in the certificate are used for marking and painting the road surface and are equipped with a uniquely configured delivery system. The tanks do not comply with the manufacturing requirements of CSA Standard B620-03, "Highway Tanks and Portable Tanks for the Transportation of Dangerous Goods".
