CONDITIONS

This Equivalency Certificate authorizes Mettron Proving Service (1998) Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are Class 3, Packing Group II or Packing Group III in means of containment that does not comply with Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment:

(i) is a volume measurement and calibration device referred to as "provers", mounted on a highway vehicle for transport to and from worksites for testing of meter equipment accuracy,

(ii) is not intended for the transportation of dangerous goods and the presence of dangerous goods is due only to the use of the means of containment for the processing, storage, or use of the dangerous goods at fixed locations,

(iii) prior to moving, is emptied to the maximum extent possible, and the residual amount of the dangerous goods never exceeds one of the following volumes in content when in transport:

(A) 50 L, or

(B) 5% of the capacity of the means of containment,

(iv) is designed, constructed, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no accidental release of dangerous goods that could endanger public safety, and

(v) when inverted, will not release dangerous goods;

(b) the means of containment is loaded and secured on the means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to an accidental release of the dangerous goods;

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(d) the permanent shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 6493 (Ren. 7)"; and

(e) equipment used to heat and circulate production fluids such as petroleum crude oil in oilfield applications are excluded from the application of this certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This certificate authorizes the transportation of means of containment that does not comply with the requirements set out in Part 5, Means of Containment, of the Transportation of Dangerous Goods Regulations. The means of containment is not used for transporting dangerous goods. The means of containment may contain residual amounts of dangerous goods due to storage, processing or use of dangerous goods at fixed locations. The means of containment must be emptied to the maximum extent possible prior to being transported.
