This Equivalency Certificate authorizes E-One Moli Energy (Canada) Limited to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by cargo aircraft, dangerous goods that are UN3480, LITHIUM ION BATTERIES, Class 9, in accordance with Special Provision A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, as incorporated by reference in subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) each cell, battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

(b) the dangerous goods are:

(i) production runs consisting of not more than 100 lithium cells and batteries, or

(ii) pre-production prototypes of lithium cells and batteries;

(c) the pre-production prototypes of cells or batteries are in transport for the purpose of testing;

(d) each cell or battery incorporates a safety venting device or is designed to preclude a violent rupture under normal conditions of transport;

(e) each cell or battery is equipped with an effective means of preventing external short circuits;

(f) each battery containing cells or series of cells connected in parallel is equipped with effective means as necessary to prevent dangerous reverse current flow (e.g. diodes, fuses, etc.);

(g) each cell or battery is individually packed in an inner packaging inside an outer packaging and is surrounded by cushioning material that is non-combustible, and non conductive;

(h) the cells or batteries are transported in an outer packaging that is a metal, plastic or plywood drum or a metal, plastic or wooden box, and that meets the criteria for Packing Group I performance level;

(i) the batteries with a mass of 12 kg or greater and having a strong, impact resistant outer casing, or assemblies of such batteries, may be transported in strong outer packagings or protective enclosures (e.g. in fully enclosed or wooden slatted crates), or on pallets;

(j) the battery or battery assembly may have a gross mass exceeding 35 kg;

(k) only the batteries and battery assemblies described in the application submitted by E-One Moli Energy (Canada) Limited to the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, can be transported under the terms of this Equivalency Certificate;

(l) a copy of this Equivalency Certificate accompanies the dangerous goods;

(m) the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(n) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SA 6422 (Ren. 9)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.
