CONDITIONS

1. This Equivalency Certificate authorizes Watts Industries (Canada) Inc. and Watts Regulator Company to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of Watts Industries (Canada) Inc. or Watts Regulator Company, by road or railway vehicle, dangerous goods that are UN3363, DANGEROUS GOODS IN APPARATUS, Class 9, when the actuators are charged with one of the dangerous goods listed in Appendix A of the certificate, in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks) and Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are contained in, and are not intended to be discharged from, the apparatus that is not dangerous goods itself and that is designed to perform a function other than solely to contain the dangerous goods;

(b) the apparatus containing the dangerous goods is an hermetically sealed metal actuator that opens or closes a valve assembly in response to temperature changes;

(c) the maximum net quantity of dangerous goods per actuator is 1.2 L, which is a quantity larger than prescribed in column 6(a) of Schedule 1 of the Transportation of Dangerous Goods Regulations;

(d) the actuators are shipped as part of a valve assembly that has a gross mass equal to or less than 115 kg. If the actuators are shipped separately from the valve assembly, the actuators are placed in a strong outer packaging; and

(e) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

2. This Equivalency Certificate authorizes Watts Industries (Canada) Inc. and Watts Regulator Company to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of Watts Industries (Canada) Inc. or Watts Regulator Company, by cargo aircraft, dangerous goods that are UN3363, DANGEROUS GOODS IN APPARATUS, Class 9, when the actuators are charged with one of the dangerous goods listed in Appendix A of the certificate, in a manner that does not comply with the total net quantity of dangerous goods in one package specified in Packing Instruction 962 of Chapter 11 of Part 4 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, incorporated by reference in subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are contained in, and are not intended to be discharged from, the apparatus that is not dangerous goods itself and that is designed to perform a function other than solely to contain the dangerous goods;

(b) the apparatus containing the dangerous goods is an hermetically sealed metal actuator that opens or closes a valve assembly in response to temperature changes;

(c) the maximum net quantity of dangerous goods per actuator is 1.2 L, which is a quantity larger than prescribed in Packing Instruction 962 of Chapter 11 or Part 4 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air;

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the transportation of dangerous goods in an apparatus, in quantities larger than prescribed in column 6(a) of Schedule 1 of the Transportation of Dangerous Goods Regulations and in Packing Instruction 962 of Chapter 11 of Part 4 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air.
