CONDITIONS

1. This Equivalency Certificate authorizes Calm Air International LPto handle, offer for transport or transport by air, dangerous goods, in a manner that does not comply with subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported by aircraft referred to in Subpart 5 of Part VII of the Canadian Aviation Regulations;

(b) the dangerous goods are transported in compliance with section 12.6 -Handling and Transporting of Toxic and Infectious Substances, except for subparagraph 12.6(b)(i) of the Transportation of Dangerous Goods Regulations;

2. This Equivalency Certificate authorizes Calm Air International LPto handle, offer for transport or transport by air, dangerous goods, in a manner that does not comply with subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported by aircraft referred to in Subpart 5 of Part VII of the Canadian Aviation Regulations;

(b) the dangerous goods are transported in compliance with section 12.9 -Limited Access, except for subparagraph 12.9(1)(c)(i) of the Transportation of Dangerous Goods Regulations;

CONDITIONS

(c) all packaging for which retention of liquid is a basic function is capable of withstanding without leakage an internal pressure producing a pressure differential of not less than 95 kPa;

(d) the dangerous goods are transported on the same aircraft to or from a location where access is limited and there is no other practical or readily available means of transport;

(e) the dangerous goods are loaded aboard the aircraft at the last aerodrome of departure utilized by the air operator to access the limited access area and no stops are permitted at any other aerodrome except for emergency reasons or re-fuelling;

3. This Equivalency Certificate authorizes Calm Air International LPto handle, offer for transport or transport by air, dangerous goods, in a manner that does not comply with subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are transported by aircraft referred to in Subpart 5 of Part VII of the Canadian Aviation Regulations;

(b) the dangerous goods are transported in compliance with section 12.17 -Flight Deck Loading Restrictions, except for subparagraph 12.17(b) of the Transportation of Dangerous Goods Regulations;

4. The air operator ensures that the personnel handling and transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate and a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the holder to transport dangerous goods as a 705 Air Operator while following the requirements set out in section 12.6 -Handling and Transporting of Toxic and Infectious Substances, section 12.9 -Limited Access, or section 12.17- Flight Deck Loading Restrictions of the Transportation of Dangerous Goods Regulations.
