This Equivalency Certificate authorizes Swagelok Company to handle, offer for transport or transport in Canada, and authorizes any person to handle, offer for transport, transport or import into Canada, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(i) and 5.10(1)(b)(i), paragraph 5.10(1)(c), subparagraph 5.10(1)(d)(i) and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) the requirements applicable to Specification TC-3EM cylinders in CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, are complied with;


(b) the cylinders were manufactured by Swagelok Company, at 4803 East 345th Street, Willoughby, OH, U.S.A., and prior to April 1, 2001, at 1924 East 337th Street, Eastlake, OH, U.S.A. in accordance with the specific procedures, designs, and with the part numbers listed in Appendix A of this certificate, filed by Swagelok Company, with the Transport Dangerous Goods Directorate;

(c) subject to conditions (d) to (f) of this certificate, the cylinders are in compliance with the requirements for specification TC-3EM as set out in National Standard of Canada CAN/CSA B339-96, "Cylinders, Spheres, and Tubes for the Transportation of Dangerous Goods", dated July 1996 and amended in December 1999, cited in the rest of this certificate as

CAN/CSA B339-96;

(d) the cylinders were manufactured from austenitic stainless steel tubing conforming to the chemical composition of Grade H, specified in Table 5.1 of CAN/CSA B339-96;

(e) samples taken from both ends and the sidewall of a cylinder representative of each new design were verified by microstructure examination for susceptibility to intergranular corrosion in accordance with Practice A of ASTM Standard A262-01, Standard Practices for Detecting Susceptibility to Intergranular Attack in Austenitic Stainless Steels;

(f) the Transport Canada mark, the specification designation and the service pressure marked on each cylinder is:

TC-SU 6158

followed by the service pressure expressed in bar.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the continued use of cylinders that were manufactured based on the TC-3EM specification requirements of a previous edition of CAN/CSA-B339, except that the material used was stainless steel as an alternative to carbon steel. The use of stainless steel in the manufacture of cylinders of Specification TC-3EM is currently permitted in the latest edition of CAN/CSA-B339, that is in effect in the current Transportation of Dangerous Goods Regulations. Nonetheless, this certificate has been renewed to authorize the continued use of cylinders previously marked "TC-SU 6158".

Under Canadian Law, a foreign manufacturer of non-specification cylinders cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the means of containment an offence (subsection 31(6)).

If none of the foregoing is adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).
