This Equivalency Certificate authorizes Plains Midstream Canada ULC to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN1978, PROPANE, Class 2.1, in a manner that does not comply with Part 3 (Documentation) and Part 4 (Dangerous Goods Safety Marks) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are contained in means of containment that comply with Part 5 of the Transportation of Dangerous Goods Regulations;

(b) the means of containment containing the dangerous goods are designed, constructed, filled, closed, maintained, and secured on a skid mounted well site unit so that under normal conditions of transport including handling, there will be no accidental release of the dangerous goods that could endanger public safety;

(c) the means of containment have displayed on them a label and the other safety marks required in sections 4.10, 4.11, and 4.12 of the Transportation of Dangerous Goods Regulations;

(d) the water capacity of each large means of containment does not exceed 454 L;

(e) the means of containment are transported in a storage compartment or cabinet, on which the safety marks required pursuant to Part 4 of the Transportation of Dangerous Goods Regulations, are displayed and visible at all times;

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(g) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The certificate holder frequently transports propane tanks and cylinders in storage compartments or skid mounted well site units to remote operating sites. Compliance with Part 3 (Documentation) of the Transportation of Dangerous Goods Regulations is difficult as exact volumes of the dangerous goods within the tanks cannot accurately be determined, since there is no means to measure propane consumption. Moreover, the Transportation of Dangerous Goods Regulations has redefined the term "small means of containment" to a capacity of 450 L or less. The certificate allows safety marks required on small means of containment to be displayed on means of containment that are 454 L or less.
