CONDITIONS

This Equivalency Certificate authorizes Chemtrade Logistics Inc., to load into or onto a railway vehicle, or unload from a railway vehicle dangerous goods that are UN1830, Sulphuric acid, Class 8, Packing Group II, or UN1831, Sulphuric acid, fuming, Class 8(6.1), Packing Group I, in a manner that does not comply with clause 10.6.2 c. of the Transport Canada Standard TP14877E, "Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard", December 2013, cited in the rest of this certificate asTransport Canada Standard TP14877E, and incorporated by reference in subparagraph 5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, regarding track protection by locked switches or locked derails, if:

(a) no railway vehicle under the control of the railway companies' servicing the Vale, Sudbury (Copper Cliff), Ontario facility, enters the siding dedicated to sulphuric acid loading;

(b) the movement of tank cars in and out of the loading rack is performed by Vale rail operations personnel;

CONDITIONS

(c) the Vale rail operations personnel responsible for the movement of tank cars at the loading rack is an integral part of the loading team;

(d) the Vale rail operations personnel is trained in the procedures pertaining to safety at the loading rack; and

(e) the loading or unloading occurs at the Vale, Sudbury (Copper Cliff), Ontario facility.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder not to use a locked switch or locked derail to protect the loading rack from railway vehicle as required by clause 10.6.2 c. of the Transport Canada Standard TP14877E. The Equivalency Certificate requires that only the Vale rail operations personnel use the dedicated dead-end siding leading to the loading rack. The rail operation personnel are well aware of the loading and unloading activities at the rack, as they are an integral part of the loading team. They are responsible for the spotting and pick-up of the cars, setting and release of handbrakes and wheel chocks and of the ground level inspection of the tank cars before and after loading. The Equivalency Certificate recognizes that using a locked derail or locked switch at this facility offers no greater level of public safety.
