CONDITIONS

This Equivalency Certificate authorizes Gas Cylinder Technologies, Inc., to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(ii), 5.10(1)(b)(iii), 5.10(1)(c)(ii), 5.10(1)(d)(iii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) the requirements applicable to Specification TC-3EM cylinders in the

CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, and cited in the rest of this certificate as CSA B340-08, are complied with;

CONDITIONS

Manufacture

(b) the cylinders are manufactured at 501 Harvard Drive, Belle River, Ontario in accordance with the specific procedures and with one of the following part numbers filed by Gas Cylinder Technologies, Inc.:

(i) part number PB-14, made of chrom-moly steel according to

subparagraph (g)(i), or

(ii) part numbers PB-12A or PB-14A, made of carbon steel according to subparagraph (g)(ii);

(c) subject to conditions (d) to (j), the cylinders are in compliance with the requirements applicable to Specification TC-3EM set out in CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, and cited in the rest of this certificate as CSA B339-08;

(d) the cylinders have a nominal outside diameter of 63,5 mm, a maximum outside diameter of 64,0 mm, and a maximum length of 305 mm;

(e) the requirement of CSA B339-08, Clause 8.5 that the cylinder shall

be manufactured from seamless tubing does not apply;

(f) each cylinder is manufactured from cold drawing of steel plate;

(g) the chemical composition of the steel complies with:

(i) Grade F specified in Table 7 of CSA B339-08, or

(ii) Table 13 of CSA B339-08;

(h) the minimum wall thickness of the cylindrical shell (sidewall) is 1,4 mm;

(i) a flattening test is performed on one cylinder from each lot of 500 or less,

in accordance with Clause 4.11 of CSA B339-08, to 6 times the wall thickness without cracking. If the cylinder fails the test, the lot is rejected;

CONDITIONS

(j) the Transport Canada mark, the specification designation, and the service pressure marked on each cylinder is: "TC - SU 5706 - 124";

(k) the documents referred to in Clause 4.19 of CSA B339-08 are retained by the manufacturer and by the Independent Inspector, as defined in that standard, for the service life of the cylinders;

(l) the certificate holder reports any incident involving loss of contents or failure of the cylinders to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada; and

(m) prior to applying for renewal of this certificate, the certificate holder reports a summary of the cylinder manufacturing and performance experience to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada.

This Certificate for Equivalent Level of Safety serves as the registration of Gas Cylinder Technologies, Inc., 501 Harvard Drive, Belle River, ON, N0R 1A0, pursuant to Clause 25.2 of CSA B339-08, to manufacture cylinders of the designs specified herein. Gas Cylinder Technologies, Inc.'s registered mark, pursuant to CSA B339-08, is:

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the manufacture and use of cylinders based on Specification TC-3EM, with increased outside diameter. The certificate holder has demonstrated that when manufactured under the conditions stipulated herein, the cylinder could be used with equivalent safety.
