CONDITIONS

This Equivalency Certificate authorizes Catalyst & Chemical Containers Alberta Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by railway vehicle, dangerous goods that are UN3190, SELF-HEATING SOLID, INORGANIC, N.O.S., Class 4.2, Packing Group II or III, in a manner that does not comply with clause 10.2.1 and Appendix E - Schedule 2 of Transport Canada Standard TP14877E, "Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard", December 2013, incorporated by reference in subparagraph 5.14(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the steel covered hopper cars conform to drawing RAILCAR, Revision A, filed by the International Catalyst Corporation;

(b) every compartment is equipped with at least one combination pressure relief device of sufficient capacity to prevent accidental pressure build-up in the compartment; each pressure relief device is periodically tested and maintained as required at an interval not exceeding seven years;

(c) each compartment is equipped with a bottom valve and auger system as described on drawing RCHA-008 filed by the International Catalyst Corporation;

(d) the hopper cars bear the following reporting marks and numbers:

(e) the certificate number "SR 5636" is stencilled on each long side of the hopper car in letters and numbers no less than 100 mm (4 in.) high;

(f) as a minimum, the interior of the hopper car is inspected visually at least every two years; and

(g) prior to offering for transport, every hopper car is inspected in accordance with the railcar inspection sheet submitted with the application and the safety relief devices are inspected, including the frangible disc for corrosion and damage that may alter its intended operation.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes Catalyst & Chemical Containers Alberta Inc., to transport UN3190, SELF HEATING SOLID, INORGANIC, N.O.S. (spent catalyst), Class 4.2, Packing Group II or III, in specially equipped railway hopper cars equipped with pressure relief devices on every compartment. Currently, the Transport Canada Standard TP14877E, "Containers for Transport of Dangerous Goods by Rail, a Transport Canada Standard", December 2013, prohibits the transport of these dangerous goods in such railway vehicles.
