CONDITIONS

This Equivalency Certificate authorizes Imperial Oil, a Partnership of Imperial Oil Limited and McColl Frontenac Petroleum, and Canada Imperial Oil Limited, an affiliate of ExxonMobil Corporation to handle, offer for transport and transport, and authorizes any person to handle or transport, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3393, ORGANOMETALLIC, SUBSTANCE, SOLID, PYROPHORIC, WATER REACTIVE, (containing aluminum alkyls), Class 4.2(4.3), Packing Group I, in a manner that does not comply with section 5.14 of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment are identified by owner serial numbers SPEP D‑3001 to SPEP D-3067, and manufactured by Manchester Tank in accordance with drawing number 37493, filed with the Executive Director, Regulatory Frameworks and International Engagement, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, on February 4, 1999;

(b) subject to condition (c) of this certificate, the means of containment are selected and used in accordance with the requirements for specification TC 51 portable tanks in CSA B621-09, "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8 and 9", January 2009;

CONDITIONS

(c) the bottom outlet of the means of containment is plugged during transport;

(d) the means of containment are tested, inspected, and repaired in accordance with the requirements for specification TC 51 portable tanks in CSA B620-09, "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2009;

(e) the means of containment are marked "TC SU 5535", in characters not less than 50 mm in height; and

(f) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 5535 (Ren. 9)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the use of existing portable tanks for the transport of UN3393, ORGANOMETALLIC, SUBSTANCE, SOLID, PYROPHORIC, WATER REACTIVE, (containing aluminum alkyls), Class 4.2(4.3), Packing Group I.

The portable tanks were designed and manufactured to the DOT 51 portable tank specification with the exception of having a bottom outlet valve while not being mounted in a full framework. The portable tanks are identified by owner serial numbers SPEP D-3001 to SPEP D-3067. These portable tanks were designed to transport solid dangerous goods under an inert gas pad in order to avoid contact with ambient air. The bottom outlet valve is centered under the tank and is protected by the tank support skirt. These tanks are subject to the applicable inspection, test and repair requirements of standards CSA B620-09.
