CONDITIONS

This Equivalency Certificate authorizes Nalco Canada Co., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, UN31A Intermediate Bulk Containers in a manner that does not comply with paragraph 13.2.7 of CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, cited in the rest of this certificate as CAN/CGSB-43.146-2002, and incorporated by reference in subparagraphs 5.14(a)(i), 5.14(b)(i), and 5.14(d)(i) of the Transportation of Dangerous Goods Regulations, if:

(a) the intermediate bulk containers have a minimum 10 gauge stainless steel wall construction and a maximum nominal capacity of 1 515 L;

(b) the intermediate bulk containers are inspected prior to each filling, in accordance with "Nalco Porta-Feed Exterior Inspection Procedure", dated November 1990, and filed by Nalco Canada Inc., with their initial application;

(c) the intermediate bulk containers are tested in accordance with and meet the requirements of section 11 and Appendix C of CAN/CGSB-43.146-2002,
every 5 years; and

CONDITIONS

(d) the certificate number "SU 5329" is visibly and legibly marked on the intermediate bulk container.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the extension of the period of time during which returnable containers are scheduled for retesting be extended to five years. Since the intermediate bulk containers are inspected prior to each shipment, this provides an equivalent level of safety.
