This Equivalency Certificate authorizes Newfoundland Marine Safety Systems Ltd., to handle, offer for transport, or transport, and authorizes any person to handle, offer for transport, or transport on behalf of the certificate holder, by road vehicle, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraph 5.10(1)(a)(i), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

(a) subject to conditions (b) to (h) of this certificate, the requirements in CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, are complied with;

(b) the cylinders are used in life rafts installed on ships;

(c) the life rafts were approved by the Marine Safety Directorate of Transport Canada, and the cylinders were manufactured and in use in Canada, on or before December 31, 1992;

(d) each cylinder was manufactured in accordance with:

(i) Specification DOT-3AA of Part 178 of Title 49 of the Code of Federal Regulations of the United States (CFR 49);

(ii) British Standard BS 5045: Part I: Transportable gas containers, Part I. Specification for seamless steel gas containers above 0.5 litre water capacity, or

(iii) British Standard BS 1288: Manganese steel gas cylinders for carbon dioxide, nitrous oxide, and ethylene;

(e) before filling, each cylinder is identified as having been requalified within the timeframe specified in CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, or the cylinder is requalified in accordance with that Standard by a facility registered under Clause 25 of that Standard;

(f) each cylinder is filled in accordance with the lesser of the following filling density or pressure requirements:

(i) those specified by the country of origin, or

(ii) those specified in CSA Standard B340-08;

(g) the cylinders are accompanied by a paper or electronic copy of this equivalency certificate; and

(h) the certificate holder reports any incident involving loss of contents or failure of the cylinders to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations not specifically addressed in this certificate.

Explanatory Note

This certificate authorizes non-TC-specification (Transport Canada) cylinders to be handled, offered for transport, or transported for the purposes of filling, requalifying, or transporting to and from the filler or requalifier. The cylinders are used in life rafts installed aboard ships in Canada. For cylinders manufactured and in use in Canada on or before December 31, 1992, this certificate authorizes the continued use of the cylinders. A previous permit also authorized cylinders manufactured and in use in Canada from January 1, 1993 to November 1, 1997 to be requalified and refilled until January 31, 2001, by which time they were to be replaced by TC-specification cylinders. This certificate no longer authorizes non-TC-specification cylinders manufactured after December 31, 1992.
