CONDITIONS

This Equivalency Certificate authorizes Carleton Technologies Inc., Pressure Technology Division to sell, offer for sale, distribute or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by aircraft or by ship, cylinders in a manner that does not comply with sections 5.1 and 5.2, subparagraphs 5.10(1)(a)(ii), 5.10(1)(b)(iii), 5.10(1)(c)(ii), and 5.10(1)(d)(iii), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, if:

Selection and Use

(a) the requirements applicable to Specification TC-3CCM cylinders in

CSA Standard B340-08,"Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008 are complied with;

CONDITIONS

Manufacture and Requalification

(b) the cylinders were manufactured,

(i) prior to August 25, 2003, at 504 McCormick Drive, Glen Burnie, MD, USA, in accordance with the specific procedures, the design qualification test reports, and part number: 6109, 6112, 6145, 6148, 6151, 6163, 6166, 6172, 6190, 6196, 6199, 6211, 6226, 6232, 6235, 6241, 6244, 6253, 6256, 6262, 6271, or 6274 filed by Carleton Technologies Inc., Pressure Technology Division,

(ii) from August 25, 2003 to September 1st, 2014, at 711 Corporate Center Court, Westminster, MD, USA, in accordance with the specific procedures, the design qualification test reports, and part number: 6109, 6109A, 6109C, 6112, 6145, 6148, 6151, 6163, 6166, 6211, 6211A, 6217, 6217A, 6217B, 6226, 6232, 6235, 6241, 6244, 6250, 6253, 6256, 6259, 6262, 6271, 6286, 6289, 6292, 6298, 6301, 6304, 6304-2, or 6328 filed by Carleton Technologies Inc., Pressure Technology Division;

(c) the cylinders are in compliance with the requirements applicable to Specification TC-3CCM cylinders set out in CSA Standard B339-08, "Cylinders, spheres, and tubes for the transportation of dangerous goods", March 2008, cited in the rest of this certificate as CSA B339-08; except that the Transport Canada mark, the specification designation, and the service pressure required to be marked on each cylinder in accordance with Clause 4.18.2 of

CSA B339-08 are replaced by "TC-SU 5303-", followed by the service pressure expressed in bar; and

(d) the cylinders are requalified in accordance with the requirements applicable to Specification TC-3CCM cylinders in CSA Standard B339-08.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows for the continued use of fully-wrapped carbon-fibre reinforced aluminum-lined cylinders that were manufactured to comply with the TC-3CCM specification, a new cylinder specification authorized by the 2008 edition of CSA Standard B339. The cylinders were previously only authorized by Equivalency Certificate and are not marked in accordance with the TC-3CCM specification.

NOTE

Under Canadian Law, a foreign manufacturer of non-specification cylinders cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the cylinders an offence (subsection 31(6)).

If none of the foregoing are adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).
