CONDITIONS

This Equivalency Certificate authorizes PPG Canada Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are residues of UN1263, Paint or Paint Related Material, Class 3, Packing Groups II and III, UN1866, Resin Solution, flammable, Class 3, Packing Groups II and III, or UN1993, Flammable Liquid, n.o.s., Class 3, Packing Groups II and III, in a manner that does not comply with sections 5.1, 5.12, and 5.14 of the Transportation of Dangerous Goods Regulations, if:

(a) the capacity of each container does not exceed 3 200 L and the residues of the dangerous goods in the containers do not exceed 5% of the container's capacity;

(b) the container being transported is covered with an anti-static plastic film and a temporary lid;

(c) the container is being transported directly from PPG Canada Inc., to a facility to be cleaned;

CONDITIONS

(d) the container is being transported in a dedicated means of transport equipped with a spill containment tray and a holding tank to prevent any leak of dangerous goods during transport;

(e) the container is being transported in a means of transport that is vented to avoid the accumulation of flammable gas;

(f) the means of transport used to transport the container has displayed on it a placard in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 5036 (Ren. 9)"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

PPG Canada Inc., is a paint manufacturing company that has several types and sizes of tanks that are used for mixing different paint formulations. These mixing tanks require frequent cleanings to rinse out the residues between batches of paint and must be transported to a washing facility that is capable of handling the tanks and the residues that are collected. These tanks, however, are not designed as transport containers and do not meet the IBC specifications in the Transport of Dangerous Goods Regulations. This Equivalency Certificate allows the paint mixing tanks to be transported to the cleaning facility in a safe manner.
