This Equivalency Certificate authorizes Nova Chemicals Corporation, to handle, offer for transport and transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle, dangerous goods that are UN1993, FLAMMABLE LIQUID, N.O.S., Class 3, Packing Group II, in a manner that does not comply with subsection 5.1(1) of the Transportation of Dangerous Goods Regulations, and Specific Requirement 3 of Clause 8.4 of CSA Standard B621-09, "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, incorporated by reference in subparagraph 5.14(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the dangerous goods are contained in portable tank 2D (serial no. B9796.5), 4E (serial no. L9706.5), 5E (serial no. 10943), 6E (serial no. 5-349898), or 7E (serial no. 5-385522);

(b) the portable tanks are periodically inspected, retested, and marked in accordance with Clause 7 of CSA Standard B620-14, "Highway tanks and TC portable tanks for the transportation of dangerous goods", January 2014, cited in the rest of this certificate as CSA B620-14, by a facility registered in accordance with Clause 8 of CSA B620-14, as though they were TC 51 portable tanks;

(c) the technical name of the most dangerous substance related to the primary class is shown, in parentheses, on the shipping document following the shipping name in accordance with clause 3.5(1)(c)(i)(A) of Part 3 (Documentation) of the Transportation of Dangerous Goods Regulations;

(d) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SH 4396 (Ren. 8)"

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(f) the portable tanks are marked with the certificate number "SH 4396" in characters at least 32 mm high, in a contrasting colour and in a clearly visible location.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to use a non specification tank that substantially meets the requirements of a TC 51 tank, except for the location of the tank openings, provided that it is inspected, retested and marked as required by CSA B620-14, as though it was a TC 51 tank, by a facility that is registered in accordance with the requirements of CSA B620-14.
