CONDITIONS

ROAD, RAIL, MARINE

1. This Equivalency Certificate authorizes B-Temia Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, in a manner that does not comply with special provision 123 of Schedule 2 of the Transportation of Dangerous Goods Regulations, if:

(a) each cell has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

(c) the dangerous goods are:

(i) production runs consisting of not more than 100 lithium cells or batteries, or

(ii) pre-production prototypes of cells or batteries;

(d) the pre-production prototypes of cells or batteries are in transport for the purpose of testing;

(e) the cells or batteries are packaged in accordance with Packing Instruction P910 of the UN Recommendations on the transport of dangerous goods - Model Regulations, 19th revised Edition, 2015;

(f) batteries that have a total mass of 12 kg or more and that have a strong, impact-resistant outer casing or assemblies of them, may be packed in an outer means of containment or protective enclosure designed, constructed, filled, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety. The batteries or battery assemblies must be protected from short-circuit;

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods; and

(i) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 12373"

2. This Equivalency Certificate authorizes B-Temia Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by cargo aircraft, dangerous goods that are UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, in accordance with Special Provision A88 of the Technical Instructions for the Safe

Transport of Dangerous Goods by Air, 2017-2018 Edition, included by reference in section 12.1 of the Transportation of Dangerous Goods Regulations, if:

(a) each cell has been determined to meet the criteria for assignment to Class 9 on the basis of tests carried out in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3;

(b) each battery or battery assembly has not been tested in accordance with the Recommendations on the Transport of Dangerous Goods - Manual of Tests and Criteria, Part III, subsection 38.3, and therefore, do not meet the inclusion criteria for Class 9;

(c) the dangerous goods are:

(i) production runs consisting of not more than 100 lithium cells and batteries, or

(ii) pre-production prototypes of lithium cells and batteries;

(d) the cells or batteries are packaged in accordance with Packing Instruction P910 of the Supplement to the Technical Instructions for the Safe

Transport of Dangerous Goods by Air, 2017-2018 Edition;

(e) the battery or battery assembly, as prepared for transport, may have a gross mass exceeding 35 kg;

(f) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods; and

(g) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 12373"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of prototype or production run batteries that have not been fully tested. The batteries are classified as UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9. The conditions of this certificate reflect the requirements outlined in special provision 123 of the Transportation of Dangerous Goods Regulations, except that only the pre-production prototypes of cells or batteries are in transport for the purpose of testing. Additional packagings may be used as described in Packing Instruction P910 of the UN Recommendations on the transport of dangerous goods - Model Regulations, 19th revised Edition, 2015.

This Equivalency Certificate is issued by the competent authority of Canada in accordance with Special Provision A88 of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, 2017-2018 Edition.
