This Equivalency Certificate authorizes Vortex Helicopters Inc., to handle, offer for transport or transport, by passenger or cargo aircraft under Part VII of the Canadian Aviation Regulations, dangerous goods that are UN1066, NITROGEN, COMPRESSED, Class 2.2, in a manner that does not comply with section 12.3 and Part 4 of the Transportation of Dangerous Goods Regulations, as well as Chapter 4 of Part 5, Chapter 1 and section 4.1 of Chapter 4 of Part 7 of the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, incorporated by reference in subsection 12.1(2) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the person who offers the dangerous goods for transport notifies the pilot in command, before the dangerous goods are transported, of the primary class and the quantity of the dangerous goods;

(b) the dangerous goods are contained in a cylinder which complies with Part 5 of the Transportation of Dangerous Goods Regulations, and which has a maximum capacity of 15.4 L;

(c) a maximum of two (2) cylinders are authorized to be transported on board the aircraft;

(d) the air operator retains a record of the cylinders handled, offered for transport or transported;

(e) the dangerous goods are transported for the maintenance and repair of the Equivalency Certificate holder's aircraft;

(f) the air operator ensures that the personnel handling and transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(g) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate allows the applicant to transport UN1066, NITROGEN, COMPRESSED, Class 2.2, without the requirements of shipping papers and notifications. The dangerous goods are transported by the certificate holder, in emergency situations, for the maintenance and repair of their aircrafts.
