CONDITIONS

This Equivalency Certificate authorizes Les Industries Desjardins Ltée, to design, manufacture, sell, offer for sale, deliver, or distribute in Canada, means of containment that are Intermediate Bulk Containers (IBCs) intended for the handling, offering for transport or transporting, by road vehicle, dangerous goods that are UN2046, CYMENES, Class 3, Packing Group III, in a manner that does not comply with paragraph 7.6 of National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, as referenced in subparagraph 5.14(1)(a)(i) of the Transportation of Dangerous Goods Regulations, if:

(a) the UN standardized IBCs are manufactured in compliance with Transport Canada Certificate of Registration number 4-691;

(b) the capacity of each UN standardized IBC does not exceed 1 100 L;

(c) the UN standardized IBCs are designed, manufactured and marked in accordance with Part 1 of National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, with the exception of paragraph 7.6;

(d) the UN standardized IBCs undergo the hydraulic pressure test with a test pressure of at least 100 kPa;

(e) the letter "W" is added to the IBC code (e.g. 31A will become 31AW); and

(f) the Equivalency Certificate number "SH 12366" is visibly, legibly and permanently marked on the means of containment.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to manufacture means of containment that are IBCs in a manner that does not comply with paragraph 7.6 of National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002. The UN 31A IBCs will undergo a maximum pressure test of 100 kPa, instead of 200 kPa as prescribed in National Standard of Canada CAN/CGSB-43.146-2002. This test pressure is considered acceptable in this case, given the intended use for these containers.
