CONDITIONS

This Equivalency Certificate authorizes lBM Canada Ltd. to handle, offer for transport or transport and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are

• UN3090, LITHIUM METAL BATTERIES (including lithium alloy batteries), Class 9,

• UN3091, LITHIUM METAL BATTERIES CONTAINED IN EQUIPMENT, (including lithium alloy batteries), Class 9,

• UN3091, LITHIUM METAL BATTERIES PACKED WITH EQUIPMENT, (including lithium alloy batteries), Class 9,

• UN3480, LITHIUM ION BATTERIES (including lithium ion polymer batteries), Class 9, or

• UN3481, LITHIUM ION BATTERIES CONTAINED IN EQUIPMENT (including lithium ion polymer batteries), Class 9,

• UN3481, LITHIUM ION BATTERIES PACKED WITH EQUIPMENT (including lithium ion polymer batteries), Class 9,

in a manner that does not comply with subsections (4) and (5) of special provision 34 of schedule 2 of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the cells and batteries are transported following the requirements of special provision 34 of schedule 2 of the Transportation of Dangerous Goods Regulations, except for subsections (4) and (5);

(b) the outer means of containment is durably and legibly marked on a contrasting background with the lithium battery mark prescribed in section 5.2.1.9 of the UN Recommendations on the Transport of Dangerous Goods, 19th revised edition;

(c) despite condition (b) of this Equivalency Certificate and until December 31, 2018, each outer means of containment may be marked with the following information:

(i) "lithium metal" or "lithium ion", as appropriate;

(ii) an indication that the means of containment must be handled with care and that a flammability hazard exists if the means of containment is damaged;

(iii) an indication that special procedures must be followed in the event the package is damaged, including inspection and repacking, if necessary; and

(iv) a telephone number to call for additional information.

(d) the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to display the lithium battery mark prescribed in section 5.2.1.9 of the UN Recommendations on the Transport of Dangerous Goods, 19th revised edition, on outer means of containment containing lithium metal or lithium ion batteries. The new lithium battery mark prescribed in section 5.2.1.9 of the UN Recommendations will eventually be adopted in the Transportation of Dangerous Goods Regulations (TDGR) through the International Harmonization Update (IHU) to the Regulations, and will replace the requirements prescribed in subsections (4) and (5) of special provision 34 of schedule 2 of the Transportation of Dangerous Goods Regulations.

As a transition period and until December 31, 2018, each outer means of containment containing the batteries may continue to be marked with the information prescribed in condition (c) of this Equivalency Certificate.
