CONDITIONS

This Equivalency Certificate authorizes DG Peinture, to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport or import, dangerous goods that are UN1950, AEROSOLS, flammable, Class 2.1, in an aerosol container, in a manner that does not comply with section 5.11 of the Transportation of Dangerous Goods Regulations, if the aerosol container is a DOT specification 2Q means of containment manufactured outside of Canada in accordance with the U.S. Department of Transportation Title 49 of the U.S. Code of Federal Regulations (49 CFR) and is filled in Canada in accordance with standard CGSB-43.123-2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, published by the Canadian General Standards Board (CGSB).

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of DOT specification 2Q means of containment that have been manufactured outside of Canada in accordance with the U.S. Department of Transportation Title 49 of the U.S. Code of Federal Regulations (49 CFR) and have been filled in Canada in accordance with standard CGSB-43.123-2010. This Equivalency Certificate is being used to implement the provisions with regards to use of DOT specification aerosol cans that will appear in the next edition of standard CGSB 43.123 "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", prior to the new standard's publishing and adoption in the Transportation of Dangerous Goods Regulations.
