CONDITIONS

This Equivalency Certificate authorizes Greywolf Energy Services Ltd., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods that are included in Class 3, Packing Group II or Packing Group III, in a means of containment that does not comply with Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment:

(i) is the property of the certificate holder,

(ii) cannot be easily cleaned or purged on site,

(iii) is known as a "service rig, fluid tank, p-tank or mud tank", is not intended for the transportation of dangerous goods, and the presence of dangerous goods is due only to the use of the means of containment for oilfield-related work, or for the processing or storage of the dangerous goods at fixed locations,

(iv) prior to moving, is emptied to the maximum extent possible, and the residual amount of the dangerous goods never exceeds the lesser of the following volume in content when in transport:

(A) 500 L, or

(B) 5% of the capacity of the means of containment,

(v) is designed, constructed, closed, secured, and maintained so that under normal conditions of transport, including handling, there will be no accidental release of dangerous goods that could endanger public safety, and

(vi) when inverted, will not release dangerous goods;

(b) despite Part 2 (Classification) of the Transportation of Dangerous Goods Regulations, the dangerous goods consisting of mixed oilfield production fluids, which is impractical to classify in the field, may be classified as UN2924, FLAMMABLE LIQUID, CORROSIVE, N.O.S., Class 3(8), Packing Group III;

(c) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(d) a paper or electronic copy of this Equivalency Certificate accompanies the dangerous goods;

(e) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 12340"

(f) the equipment used to heat and circulate production fluids such as petroleum crude oil, in oilfield applications are excluded from the application of this certificate;

(g) the conditions of this Equivalency Certificate are all met. Subsection 31(4) of the Transportation of Dangerous Goods (TDG) Act, 1992 stipulates that non-compliance with any of the terms or conditions invalidates the certificate.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of dangerous goods that are included in Class 3, Packing Group II or Packing Group III, in means of containment that do not comply with the requirements set out in Part 5 (Means of Containment) of the Transportation of Dangerous Goods Regulations. The means of containment may contain residual amounts of dangerous goods due to oilfield-related work, or to the processing or storage of the dangerous goods at fixed locations. They must be emptied to the maximum extent possible prior to being transported.

This Equivalency Certificate also authorizes relief from Part 2 (Classification) of the Transportation of Dangerous Goods Regulations for the handling, offering for transport or transporting of mixed oilfield production fluids. Due to the nature of oilfield production fluids and the variance in composition, the dangerous goods may be classified as UN2924, FLAMMABLE LIQUID, CORROSIVE, N.O.S., Class 3(8), Packing Group III.
