CONDITIONS

This Equivalency Certificate authorizes Harnois Groupe Petrolier, to handle, offer for transport or transport and authorizes any person on behalf of the certificate holder to handle, offer for transport or transport, by highway tank truck on railway flat car, dangerous goods that are UN1202, DIESEL FUEL, GAS OIL or HEATING OIL, LIGHT, Class 3, Packing Group III or UN1203, GASOLINE, MOTOR SPIRIT or PETROL, Class 3, Packing Group II, in a manner that does not comply with subparagraph 5.10(1)(b)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the highway tank truck is selected and used in accordance with the requirements of the CSA standard B621-09, "Selection and use of highway tanks, TC portable tanks, and other large containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009;

(b) the highway tank truck is tied down to the railway flat car in accordance with the requirements of the AAR Open Top Loading Rules Manual, following the rules applicable to "Four or six wheel truck or other motor vehicle" for the tractor and to "Trailer, all types" for the trailer. Further, the front part of the trailer chassis must be tied down to the floor of the flat car, and the bumpers and landing gear must not be used as points of attachment for securing the vehicle;

c) before the person responsible for the road transport of the dangerous goods releases the highway tank truck to the rail carrier, that person inspects the attachment points of the tank to the truck or trailer frame to detect any condition that may compromise the integrity of the securement of the tank to the frame, to ensure that the highway tank has all valves and closures, at the exclusion of the pressure-relief device, securely closed and capped as applicable, and reports the results of this inspection and this verification to the rail carrier;

(d) the railway vehicle on which the highway tank truck is transported is separated by at least one railway vehicle from a railway vehicle for which a placard is required to be displayed in accordance with Part 4 of the Transportation of Dangerous Goods Regulations, is separated by at least one railway vehicles from the locomotive and is located at the tail end or as close as possible to the tail end of the train and behind any loaded railway vehicle;

(e) the railway flat car carrying the loaded highway tank is equipped on each of its draft sills with an end of car cushioning device meeting the requirements of the Association of American Railroads (AAR) standards M 921B or M 921E;

(f) the transportation is performed on the railway line running between Sept-Îles, QC and Poste Montagnais, QC, by Quebec North Shore and Labrador Railway (QNS & L);

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SR 12337"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport dangerous goods in highway tank trucks on railway flat cars. Some remote areas of Canada are accessible only by rail, year around or seasonally, and do not have access to a highway tank for the distribution of fuels within the community or industrial site.

The Transportation of Dangerous Goods Directorate has revised its policy on the handling, offering for transport and transport of dangerous goods by highway tank trucks on railway flat cars. In the past, equivalency certificates have been issued to authorize the use of highway tank trucks on railway flat cars in the event that there were no means of containment specifications available to safely transport the dangerous goods by rail. Over the years, the Transportation of Dangerous Goods Regulations have been updated and now include various means of containment options for the transport of Class 3 by rail.

It has been determined that after January 1, 2020, the use of highway tanks on railway flat cars to transport dangerous goods of Class 3 will no longer be authorized. Users will have to consider replacing their highway tanks with means of containment specifications authorized by the Transportation of Dangerous Goods Regulations for the transport of dangerous goods of Class 3 by rail.

This Equivalency Certificate will not be renewed for the transport of dangerous goods of Class 3 by highway tanks on railway flat cars beyond January 1, 2020.
