CONDITIONS

This Equivalency Certificate authorizes Vitality Air Inc., to sell, offer for sale, distribute, or deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import, dangerous goods that are UN1950, AEROSOLS, containing compressed oxygen, Class 2.2(5.1), or UN1950, AEROSOLS, non-flammable, Class 2.2, in an aerosol container, in a manner that does not comply with section 5.11 of the Transportation of Dangerous Goods Regulations, if the aerosol container:

(a) is a DOT specification 2Q means of containment manufactured in accordance with the U.S. Department of Transportation Title 49 of the U.S. Code of Federal Regulations (49 CFR);

(b) is filled in accordance with the requirements of standard CGSB 43.123 2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, that are applicable to the TC-2Q specification and the specific procedures for "air and oxygen filling and testing" filed with the Director, Regulatory Affairs Branch, Transportation of Dangerous Goods Directorate, Transport Canada, on September 8, 2016.

: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transportation of DOT specification 2Q means of containment that have been manufactured in accordance with 49 CFR. The aerosol container is filled with Class 2.2 dangerous goods in Canada in accordance with the requirements of standard CGSB 43.123 2010, "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", June 2010, normally applicable to the TC-2Q specification. This Equivalency Certificate is being used to implement the provisions with regards to use of DOT specification aerosol cans that will appear in the next edition of standard CGSB 43.123 "Aerosol Containers and Gas Cartridges for Transport of Dangerous Goods", prior to the new standard's publishing and adoption in the Transportation of Dangerous Goods Regulations.

This certificate will not be renewed beyond July 31, 2018.
