CONDITIONS

This Equivalency Certificate (National Competent Authority Approval) authorizes Agnico Eagle, the use of the following UN standardized packagingunder the following conditions:

(a) the dangerous goods are packaged in UN standardized fiberboard boxes, with specification UN 4G/Y13.6/S/14 USA/+AV1091;

(b) the dangerous goods have been classified as UN0349, ARTICLES, EXPLOSIVE, N.O.S. (HMX, Aluminum), Class 1.4S, Packing Group II, by the Chief Inspector of Explosives, Explosives Regulatory Division, Natural Resources Canada as shown in Certificate of Authorization no. XP2050‑D19‑07072701; and

CONDITIONS

(c) the shipping document that accompanies each shipment packaged as authorized in this Equivalency Certificate includes the following information legibly and indelibly printed:

"Packaging approved by the Competent Authority of Canada"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

The Transportation of Dangerous Goods Directorate, Transport Canada confirms that the packaging listed in this Equivalency Certificate (National Competent Authority Approval) is deemed to be as equally effective as other packaging for explosives of Class 1 and acceptable to the Canadian Authorities on the basis of test results that exceed those specified in Chapter 6.1 of the UN Recommendations on the Transport of Dangerous Goods for packaging intended for Packing Group II dangerous goods.

An Equivalency Certificate (National Competent Authority Approval) is required as per:

(i) Packing Instruction 101 of Chapter 3, Part 4, of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, which requires packaging approved by the Competent Authority of Canada for air transport;

(ii) Packing Method EP01 of the standard CGSB 43.151-2012, "Packaging, handling, offering for transport and transport of Explosives (Class 1)", which requires packaging approved by the Competent Authority of Canada;

(iii) Packing Instruction P101 of the UN Recommendations on the Transport of Dangerous Goods - Model Regulations, which requires packaging approved by the Competent Authority of Canada;

(iv) Packing Instruction P101 of the International Maritime Dangerous Goods Code, which requires packaging approved by the Competent Authority of Canada for marine transport.
