CONDITIONS

This Equivalency Certificate authorizes Fédération des coopératives du Nouveau-Québec and its member co-ops, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the Fédération des coopératives du Nouveau-Québec and its member co-ops, by road vehicle or by ship on a domestic voyage, dangerous goods that are UN3175, SOLIDS CONTAINING FLAMMABLE LIQUID, N.O.S., Class 4.1, Packing Group II, in a manner that does not comply with subparagraphs 5.14(1)(a)(i) and 5.14(1)(d)(i) of the Transportation of Dangerous Goods Regulations with regards to the selection of an intermediate bulk container that is not permitted by Packing Instruction 6 of the National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, if:

(a) the dangerous goods are contaminated soils and are contained in UN standardized flexible intermediate bulk containers (FIBC) code 13H3 or 13H4;

(b) the FIBC are transported in or on a means of transport designed to facilitate cleaning and decontamination;

CONDITIONS

(c) there is no free liquid visible at the time the dangerous goods are loaded or at the time the FIBC and transport unit are closed;

(d) when transported on board an open vehicle, the FIBC are water-tight and constructed so that neither rain nor road spray can come into contact with the dangerous goods;

(e) the Fédération des coopératives du Nouveau-Québecensures that a copy or electronic copy of this Equivalency Certificate is provided to all its member co-ops;

(f) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the Fédération des coopératives du Nouveau-Québec and its member co-ops ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate; and

(g) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11893"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This certificate is issued in order to allow Fédération des coopératives du Nouveau-Québec and its member co-ops to use UN standardized flexible intermediate bulk containers (FIBC)that are not authorized by National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods". These UN standardized FIBC are made of woven plastic with liner and are to be used for the transportation of contaminated soils.
