CONDITIONS

This Equivalency Certificate authorizes the members of the North American Automotive HazMat Action Committee (NAAHAC), to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the members of the certificate holder, by road vehicle, means of containment in a manner that does not comply with section 4.9 (Removal or Change of Dangerous Goods Safety Marks) of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment contained dangerous goods used by a member of the NAAHAC before they are offered for transport;

(b) the appropriate dangerous goods safety marks are displayed on the means of containment in accordance with Part 4 of the Transportation of Dangerous Goods Regulations;

(c) the means of containment are transported in closed transport units so that the dangerous goods safety marks are not visible in transportation;

CONDITIONS

(d) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the empty means of containment is trained in regards to the conditions of this Equivalency Certificate; and

(e) a shipping document accompanies the means of containment and includes the following information legibly and indelibly printed:

(i) "Equivalency Certificate No. SH 11892", and

(ii) "Empty means of containment returning to manufacturer/supplier for reuse".

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the members of the NAAHAC to transport empty means of containment, without removing the dangerous goods safety marks, from their place of business, to the manufacturer/supplier facility of the dangerous goods, when they follow the conditions outlined in this certificate.
