CONDITIONS

This Equivalency Certificate authorizes Advanced Flow Systems Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road vehicle or by ship on a domestic voyage, dangerous goods that are UN3190, SELF-HEATING SOLID, INORGANIC, N.O.S. (reduced copper catalysts), Class 4.2, Packing Group II, contained in a piece of equipment in a manner that does not comply with subsection 5.1(1) and paragraphs 5.14(1)(a), 5.14(1)(d) of the Transportation of Dangerous Goods Regulations, if, the piece of equipment:

(a) is manufactured by Advanced Flow Systems Inc.;

(b) is a fuel cell power plant assembly using the dangerous goods as the catalyst;

(c) is designed in accordance with Doosan Fuel Cell America, Inc. drawing number FC79613, rev. H, on file with the Transportation of Dangerous Goods Directorate, Transport Canada;

CONDITIONS

(d) conforms to the requirements in Clause 4 in CSA standard B621-09, "Selection and use of highway tanks, TC portable tanks, and other large

containers for the transportation of dangerous goods, Classes 3, 4, 5, 6.1, 8, and 9", January 2009, for solids of Class 4.2 and Packing Group II;

(e) the combined vapour pressure of the dangerous goods and any gas, or mixture of gases, that fills the vacant space inside the piece of equipment is less than 200 kPa, absolute (29 psia);

(f) for transport by ship, the piece of equipment is stowed under deck or, if stowed on deck, is protected from exposure to weather and seawater;

(g) has safety marks displayed on it in accordance with Part 4 (Dangerous Goods Safety Marks) of the Transportation of Dangerous Goods Regulations;

(h) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, Advanced Flow Systems Inc., ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(i) the document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11872"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport a fuel cell assembly containing a Class 4.2, Packing Group II, solid dangerous goods that is a catalyst necessary for the operation of the fuel cell. Domestic and international regulations currently lack packaging instructions for apparatus containing dangerous goods in quantity exceeding the limited quantity assigned to the dangerous goods. The fuel cell assembly is a large and robust article that meets the general the packaging requirements assigned to most solids for transport by road in non-specification means of containment. In addition, the article itself must be protected from the elements during sea transport.
