CONDITIONS

This Equivalency Certificate authorizes the members of the Railway Supply Institute to handle, offer for transport, transport or import into Canada, and authorizes any person to handle, offer for transport, transport or import into Canada, by railway vehicle, dangerous goods in an Enhanced Class 111 tank car in a manner that does not comply with subsection 5.1(1), paragraphs 5.15(1)(b) and (c), paragraphs 5.15.1(1)(a) and (b), paragraph 5.15.2(1)(a), paragraphs 5.15.3(1)(a) and (b), and paragraph 5.15.4(1)(a) of the Transportation of Dangerous Goods Regulations, if:

(a) the Enhanced Class 111 tank car was manufactured by a member of the Railway Supply Institute;

(b) the Enhanced Class 111 tank car was manufactured prior to July 1, 2015;

(c) the Enhanced Class 111 tank car is in compliance with the requirements of subsection 5.15.7(1) or subsection 5.15.7(2), except for the requirement of paragraph 5.15.7(1)(k) of the Transportation of Dangerous Goods Regulations;

CONDITIONS

(d) if the tank car is equipped with a bottom outlet, the bottom outlet design is in compliance with paragraph E.9.1.2.8 of the Association of American Railroads (AAR) publication Specifications for Tank Cars (M-1002), issue of November 2014;

(e) the Railway Supply Institute ensures that a paper or electronic copy of this Equivalency Certificate is provided to all its members.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations,the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulations not specifically addressed in this certificate.

Explanatory Note

The Enhanced Class 111 Tank Car specification in the Transportation of Dangerous Goods Regulations is intended to authorize CPC-1232 tank cars for the transport of flammable liquids during the phase-out of Class 111 tank cars. This Equivalency Certificate aligns the bottom outlet requirement for Enhanced Class 111 with the Association of American Railroads requirements for such, which differed for tank cars manufactured prior to July 2015.
