This Equivalency Certificate authorizes Air Liquide Canada Inc., to handle, offer for transport or transport, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road vehicle, dangerous goods that are UN1049, HYDROGEN, COMPRESSED, Class 2.1, in means of containment, in a manner that does not comply with subparagraph 5.10(1)(a)(ii) of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment is a specification TC-3AAXM or TC-3AXM tube or an equivalent container as defined in CSA Standard B340-08, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", March 2008, and cited in the rest of this certificate as CSA B340-08, and the requirements in CSA B340-08 are complied with except that the reference in Clause 4.3.1 of CSA B340-08 to CGA Publication S-1.1 is read as a reference to CGA Publication S-1.1-2011, "Pressure Relief Device Standards - Part 1 - Cylinders for Compressed Gases", Fourteenth Edition, published by the Compressed Gas Association, Inc. despite Clause 2 of CSA B340-08; and

(b) the certificate holder reports any incident involving loss of contents or failure of the means of containment to the Director, Regulatory Affairs Branch, Transport Dangerous Goods Directorate, Transport Canada.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transport of UN1049, hydrogen, compressed, in tubes without pressure-relief devices. The 2014 edition of CSA B340, which has been published and is expected to be adopted into the Transportation of Dangerous Goods Regulations, will allow this practice through the adoption of the latest edition of CGA Publication S-1.1. The certificate holder has demonstrated that when used under the conditions stipulated herein, the tubes could be used with an equivalent level of safety.
