CONDITIONS

This Equivalency Certificate authorizes Zierke Built Manufacturing, Inc., to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods contained in Intermediate Bulk Containers (IBC), which do not comply with paragraph 6.1.7 of National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, incorporated by reference in subparagraphs 5.14(1)(a)(i), 5.14(1)(b)(i), and 5.14(1)(d)(i) the Transportation of Dangerous Goods Regulations, if:

(a) the UN standardized mobile Intermediate Bulk Containers are manufactured at the facilities of Zierke Built Manufacturing, Inc.;

(b) the UN standardized mobile Intermediate Bulk Containers are manufactured in compliance with Transport Canada Certificate of Registration Number 4‑688;

(c) the openings of the mobile Intermediate Bulk Containers, which are located in the liquid space, are fully enclosed in the footprint of the mobile Intermediate Bulk Containers or sufficiently protected on each side to prevent the loss of the dangerous good content in the case of an accident;

CONDITIONS

(d) the openings of the mobile Intermediate Bulk Containers are constructed of metal that is not subjected to deterioration by the lading;

(e) the openings of the mobile Intermediate Bulk Containers are closed by a plug, a valve or other service equipment located as close to the body of the mobile Intermediate Bulk Containers as practical.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

According to paragraph 6.1.7 of National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, the openings for a mobile IBC must be located in the vapour space of the IBC. However, a new edition of the Standard CGSB-43.146 has recently been published and allows mobile IBCs to have openings located in the liquid space under certain conditions. The application for an Equivalency Certificate submitted by Zierke Built Manufacturing, Inc. meets the requirements of the new standard. However, until the new standard is referenced in the Transportation of Dangerous Goods Regulations, an Equivalency Certificate is required. The IBC design 4-688 will include two bottom openings that are sufficiently protected and closed by either a valve that can be secured in the closed position or a plug.
