CONDITIONS

This Equivalency Certificate authorizes Canadian Pacific Railway, to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the certificate holder, by railway vehicle, dangerous goods that are UN1075, LIQUEFIED PETROLEUM GASES, Class 2.1, in a means of containment that does not comply with section 5.1 and paragraph 5.10(1)(b) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the means of containment is selected and used in accordance with CSA Standard B622-09 "Selection and use of highway tanks, TC portable tanks, and ton containers for the transportation of dangerous goods, Class 2", dated January 2009, except that the 5% fill limit of Specific Requirement 24 of Clause 6.2 does not apply;

(b) the means of containment is a non-specification tank:

(i) with serial number X221, a Canadian Registration Number (CRN) 9946436512, a capacity of 1893 L (500 US gallons), and containing not more than 60% of its capacity. The tank is transported for storage directly from mile 50.3 Shuswap Subdivision to Sicamous yard, BC, for a distance of 8.5 km (5.3 miles),

CONDITIONS

(ii) with serial number X220, a Canadian Registration Number (CRN) 9946436512, a capacity of 1893 L (500 US gallons), and containing not more than 60% of its capacity. The tank is transported for storage directly from mile 50.3 Shuswap Subdivision to Sicamous yard, BC, for a distance of 8.5 km (5.3 miles),

(iii)with serial number 33982A, a Canadian Registration Number (CRN) A5882.21345, a capacity of of 3785 L (1000 US gallons), and containing not more than 50% of its capacity. The tank is transported for storage directly from mile 101.6 Mountain Subdivision to Albert Canyon yard, BC, for a distance of 5.5 km (3.4 miles),

(iv)with serial number 33969A, a Canadian Registration Number (CRN) A5882.21345, a capacity of of 3785 L (1000 US gallons), and containing not more than 50% of its capacity. The tank is transported for storage directly from mile 101.6 Mountain Subdivision to Albert Canyon yard, BC, for a distance of 5.5 km (3.4 miles),

(v) with serial number Q1104140, a Canadian Registration Number (CRN) T3425.42/M0770.5, a capacity of 7570 L (2000 US gallons), and containing not more than 70% of its capacity. The tank is transported for storage directly from mile 115.0 Mountain Subdivision to Downie, BC, for a distance of 21.5 km (13.4 miles),

(vi)with serial number Q1202820, a Canadian Registration Number (CRN) T3425.42/M0770.5, a capacity of 7570 L (2000 US gallons), and containing not more than 60% of its capacity. The tank is transported for storage directly from mile 115.0 Mountain Subdivision to Downie, BC, for a distance of 21.5 km (13.4 miles);

(c) all regulators, hoses, pigtails, and other accessories, that protrude from under the protective dome are removed;

(d) all valve openings, except relief valves, are either capped or plugged;

(e) the dome cover is secured in the closed position with a bolt or wire;

(f) the lifting lugs on the tank are not used to lift the tank;

(g) the tank is lifted using straps having a strength of at least 5 times the applied load, properly placed around the tank's shell;

CONDITIONS

(h) the tank is supported on cradles designed to distribute the weight of the tank and contents over the shell and to remove the weight from the tank's legs;

(i) the tank is secured to the Hi-Rail vehicle using tie downs having a strength of at least 5 times the applied load;

(j) the Hi-Rail vehicle, by design and size, is capable of safely carrying the propane tank and its contents;

(k) the tanks are transported on Canadian Pacific property and will not be transported on any public property at any time during the movement;

(l) the tanks are transported at a reduced speed of 16 km/h (10 mph);

(m) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(n) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SR 11822"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to transport non-specification tanks containing propane up to 70% of its capacity to new locations in order to be disposed or re-used.

This Equivalency Certificate will not be renewed.
