Certificate Holder: Clean Harbors and all affiliated companies

CONDITIONS

This Equivalency Certificate also authorizes Clean Harbors and all affiliated companies, to handle, offer for transport or transport, and authorizes any person to handle or transport, on behalf of the certificate holder, by road or railway vehicle, or by ship on a domestic voyage, dangerous goods of Classes 3, 4, 5, 6.1, 8, and 9, in a manner that does not comply with subsection 5.12(2) of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are transported for disposal, recycling or any other reclamation process;

(b) the means of containment are drums that are eligible for reconditioning in accordance with Canadian General Standards Board CGSB-43.126-2008, "Reconditioning, Remanufacturing and Repair of Drums Used for the Transportation of Dangerous Goods", September 2008;

(c) the drums are visually inspected prior to being refilled to ensure that they are free from corrosion, contamination or other damage;

(d) the drums may be reused only once and must be reconditioned before subsequent use;

CONDITIONS

(e) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the certificate holder ensures that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(f) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Equivalency Certificate No. SU 11820"

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the certificate holder to reuse drums to transport dangerous goods intended for disposal, recycling or any other reclamation process, without having been reconditioned in accordance with Canadian General Standards Board CGSB-43.126-2008, "Reconditioning, Remanufacturing and Repair of Drums Used for the Transportation of Dangerous Goods", September 2008.
