CONDITIONS

This Equivalency Certificate authorizes the members of the Reusable Industrial Packaging Association (RIPA)to handle, offer for transport or transport, and authorizes any person to handle or transport on behalf of the members of the Reusable Industrial Packaging Association (RIPA), by road or railway vehicle, or by ship on a domestic voyage, residue of dangerous goods contained in a drum or an intermediate bulk container (IBC), in a manner that does not comply with Part 3 (Documentation), Part 4 (Dangerous Goods Safety Marks), and Part 7 (Emergency Response Assistance Plan)of the Transportation of Dangerous Goods Regulations, under the following conditions:

(a) the dangerous goods are not:

(i) included in Packing Group I,

(ii) contained in a drum or an IBC otherwise requiring a label or a placard for Class 1, 4.3, 6.2 or 7;

(b) the drum has been emptied to the maximum extent possible using the most effective method (e.g. can include pouring, upending, pumping, aspirating, scraping, rinsing) for the type of dangerous good and is less than 10 per cent full;

CONDITIONS

(c) the IBC has been emptied to the maximum extent possible using the most effective method (e.g. can include pouring, upending, pumping, aspirating, scraping, rinsing) for the type of dangerous good and is less than 1 per cent full;

(d) the drum and/or the IBC are being transported to a Drum Reconditioning, Remanufacturing and Repair Facility in accordance with standard CGSB-43.126-2008, "Reconditioning, Remanufacturing and Repair of Drums Used for the Transportation of Dangerous Goods", September 2008, an IBC Leak Test and Inspection Facility in accordance with National Standard of Canada CAN/CGSB-43.146-2002, "Design, Manufacture and Use of Intermediate Bulk Containers for the Transportation of Dangerous Goods", January 2002, or to an appropriate facility for disposal or recycling;

(e) the road or railway vehicle has displayed on it the DANGER placard as illustrated in the Appendix of Part 4 (Dangerous Goods Safety Marks) of the Transportation of Dangerous Goods Regulations;

(f) before allowing a carrier to take possession of the drums and IBCs for transport, the consignor prepares and gives to the carrier a document that includes the following information:

(i) the primary class of each residue followed by the words "Residue Drum(s)" or "fût(s) de résidu", or "Residue IBC(s)", or "GRV(s) de résidu", preceded by the number of drums and IBCs containing dangerous goods with that primary class (Examples: 14 Class 3 Residue Drums, 14 Class 3 Residue IBCs),

(ii) "Equivalency Certificate No. SU 11819";

(g) in addition to the requirements of Part 6 (Training) of the Transportation of Dangerous Goods Regulations, the members of the Reusable Industrial Packaging Association (RIPA) must ensure that the personnel handling, offering for transport or transporting the dangerous goods is trained in regards to the conditions of this Equivalency Certificate;

(h) the Reusable Industrial Packaging Association (RIPA)must ensure that a paper or electronic copy of this Equivalency Certificate is provided to all its members;

CONDITIONS

(i) a current proof of membership with the Reusable Industrial Packaging Association (RIPA)must be readily available upon request.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations, the Technical Instructions for the Safe Transportation of Dangerous Goods by Air, the International Maritime Dangerous Goods Code, and the Canadian Aviation Regulationsnot specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the members of the Reusable Industrial Packaging Association (RIPA) to transport empty drums and IBCs containing small quantities of dangerous goods for reconditioning, recycling or disposal. The conditions of this Equivalency Certificate are similar to the requirements of section 1.44 (Residue of Dangerous Goods in a Drum Exemption) of the Transportation of Dangerous Goods Regulations. This Equivalency Certificate authorizes the display of the DANGER placard on the road or railway vehicle containing two or more IBCs (which are large means of containment).

It is expected that the Transportation of Dangerous Goods Regulations will be modified to reflect the conditions of the Equivalency Certificate.
